1984-176-Granting Appeal From Decision Of The Building Official Concerning Handicapped Access Requirements-St. HonoreRESOLUTION NO. 1984 -176 RESOLUTION GRANTING APPEAL FROM DECISION OF THE BUILDING OFFICIAL CONCERNING HANDICAPPED ACCESS REQUIREMENTS (114 North Santa Cruz Avenue - St. Honore) WHEREAS: 1. Arthur K. Yeap on behalf of St. Honore has appealed a decision of the Building Official as follows: requiring a handicapped accessible sanitary facility for the reiiiodeled store at 114 North Santa Cruz Avenue; and 2. A public hearing was held by the Town Council on September 17, 1984. IT IS HEREBY RESOLVED: 1. The Town Council hereby finds that an unreasonable hardship exists in requiring a handicapped accessible sanitary facility as follows: a. The total area of space for the store is less than 200 square feet and the width of the store is seven feet; b. The cost to modify the sanitary facility to meet the handicapped accessible regulations of Title 24 of the California Administrative Code is estimated to be between $2000 - $5000; and C. Construction of a handicapped accessible sanitary facil- ity is physically impractical because of the size and width of the store and would result in usage of approx- imately one -half of the square footage of the store area for the sanitary facility. 2. Based on the foregoing findings, the appeal is granted as follows: a. The sanitary facility serving the remodeled area need not be modified to comply with the handicapped acces- sibility regulations of Title 24 of the California Administrative Code. b. The front entrance of the store must be modified to provide level landing at both sides and a minimum 32- inch clear opening. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review of the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos held on tie 1st day of October , 1984 by the following vote: AYES: COUNCILMEMBERS Joanne Ben.iamin, Eric D.
