1984-165-Granting Appeal Of Business Official's Decision Relating To Handicapped Access Requirements For A New Office Building-Joel GambordRESOLUTION NO. 1984 -165 RESOLUTION GRANTING APPEAL OF BUILDING OFFICIAL'S DECISION RELATING TO HANDICAPPED ACCESS REQUIREMENTS FOR A NEW OFFICE BUILDING (300 East Main Street - Joel Gambord) WHEREAS: 1. Joel Gambord has appealed a decision of the Building Official requiring all sanitary facilities be handicapped accessible in the new office building to be constructed at 300 East Main Street; 2. A public hearing was held by the Town Council on September 4, 1984. IT IS HEREBY RESOLVED: 1. The Town Council finds as follows: a. The State Architect has determined that State law does not require sanitary facilities serving a building owner's private office be handicapped accessible; b. The building owner will be using the sanitary facility serving his own office; c. The building is to be 1,000 square feet with one handicapped accessible sanitary facility; and d. The building will have very little public traffic because of the proposed use of the building. 2. Based on the foregoing findings, the appeal is granted as follows: a. The sanitary facility serving the private office will not be required to be handicapped accessible; and b. The building shall be provided with one handicapped accessible sanitary facility for use by employees, clients or the public. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review of the Town Council decision is governed by California Code of Procedure Section 1094.6.
