RESOLUTION DENYING APPEAL OF BUILDING OFFICIAL'S DECISION
RELATING TO HANDICAPPED ACCESS REQUIREMENTS FOR
PROPOSED ADDITION TO AUTOMOBILE SALES BUILDING
WITH CERTAIN MODIFICATIONS THERETO
(15600 Los Gatos Boulevard - Countryman Oldsmobile- Cadillac)
WHEREAS:
1. Gregory R. Smith, Project Manager for Barry Swenson Builder, has
appealed a decision of the Building Official requiring modifications to a new
two -story office addition and alterations to an existing automobile sales
facility to meet the handicapped access requirement of Title 24 of the
California Administrative Code;
2. A public hearing was held by the Town Council on September 4, 1984;
IT IS HEREBY RESOLVED:
1. The Town Council finds as follows:
a. The Building Official's decision to modify sanitary facilities
serving the areas being remodeled to comply with handicapped access regulations
was correct.
b. The Building Official's decision to provide interior ramp access to
both levels was correct.
c. The Building Official's decision to modify the existing ramp entry
to the showroom to provide level landing at both sides of the door was correct;
however, equivalent facilitation may be used (such as automatic doors) to
provide handicapped access to the showroom.
2. Based on the foregoing findings, the appeal is denied and the decision
of the Building Official is approved, except that equivalent facilitation to
provide access to the showrooms as set forth in finding l.c above shall be
allowed.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
,judicial review of the Town Council decision is governed by California Code of
Procedure Section 1094.6.

regular meeting held this 17th day of September , 1984E
