RESOLUTION DENYING APPEAL OF PLANNING COMMISSION
CHOICE OF SPECIES OF STREET TREES FOR
ARCHITECTURE AND SITE APPLICATION
(Alerche Drive and Harwood Road - Dividend Development Corporation)
WHEREAS:
1. W.T. Quigley has appealed a decision of the Planning Commission as
follows: a decision to require live oak trees to be planted along Harwood
Road as conditions to Architecture and Site Application S -33 -54 (Alerche
Drive Lot 1) and Architecture and Site Application S -83 -56 (Alerche Drive
Lot 3); and
2. A public hearing was held on August 20, 1984.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the findings and decision of
the Planning Commission were correct.
2. The Town Council further finds that live oaks are the appropriate
choice for street trees along Harwood Road at Alerche Drive as follows:
a. Live oafs are native to the Harwood Road area,
continuing a rural feeling;
b. Live oaks are an easily established, drought -
resistant specimen, requiring a minimum amount
of care to become established; and
c. The Town has selected live oaks because they need
little pruning and are relatively pest resistant.
3. The Town Council further finds that liquid ambers and camphors
are not appropriate for street trees because of falling branches during
storms, invasive surface roots, and insect problems of liquid ambers.

4. based on the foregoing findings, the appeal is hereby denied.
Pursuant to Los Gatos Town Code Section 1-15, the time for seeking
judicial review of the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.
