1984-142-Granting Appeal From Decision Of The Building Official Regarding Handicapped Access Requirements-Paul D. Indman, M.D.RESOLUTION NO. 1984 -142 RESOLUTION GRANTING APPEAL FROM DECISION OF THE BUILDING OFFICIAL REGARDING HANDICAPPED ACCESS REQUIREMENTS (15195 National Avenue - Paul D. Indman, M.D.) WHEREAS: 1. Paul D. Indman, M.U., and Paul D. Indman, M.D. A Professional Medical Corporation, appealed a decision of the Building Official as follows: requiring provision of handicapped accessible sanitary facilities for all four sanitary facilities planned for the proposed medical office condominium suite located at 15195 National Avenue; and 1984; 2. A public hearing was held by the Town Council on August 6, IT IS HEREBY RESOLVED: 1. The Town Council hereby finds as follows: a. According to Health & Safety Code Section 19955.5, when sanitary facilities are made available for the public, clients, or employees in office buildings, they shall be made available for the Physically handicapped; b. According to the Office of the State Architect, sanitary facilities in a private office serving a building owner need not be made handicapped accessible if handicapped accessible sanitary facilities are provided for the public, clients, and employees; c. The building owner of 15195 National Avenue is appellant; and d. Appellant has agreed to delete the sanitary facility serving the private office not to be occupied by Dr. Paul D. Indman. follows: 2. Based on the foregoing findings, the appeal is granted as a. The sanitary facility serving the private office of Dr. Paul Indman need not be made handicapped accessible; b. The sanitary facility adjacent to the staff lounge must be made handicapped accessible, of sufficient size to accommodate a handicapped person and with a door that is usable by a handicapped person; c. The sanitary facility adjacent to the waiting room must be made handicapped accessible; and d. No sanitary facility will be allowed in the private office not occupied by Dr. Paul Indman. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review of the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos held on the 20th day of August 1984 by the following vote: AYES: COUNCILMEMBERS Joanne Benjamin, Eric D.
