1984-128-Intention To Abandon A Portion Of The Public Utility Easement Along The Easterly Property Line At 210 Milbrae LaneRESOLUTION NO. 1984 -128 A RESOLUTION OF INTENTION TO ABANDON A PORTION OF THE PUBLIC UTILITY EASEMENT ALONG THE EASTERLY PROPERTY LINE AT 210 MILBRAE LANE RESOLVED: 1. It is the intention of the Town Council to vacate, under the provisions of Sections 8300 through 8325 of the Streets and Highways Code, a public utility easement situated in the Town of Los Gatos, County of Santa Clara, State of California, consisting of a strip of land approximately 6 feet wide containing approximately 0.012 acres located along the easterly property line at 210 Milbrae Lane, and more particularly described in Exhibit "A" "Description of Excess Portion of a Public Utility Easement to be Abandoned by the Town of Los Gatos ", and Exhibit "B" (Plat to Accompany Public Utility Easement Abandonment), copies of which are attached hereto. Said Exhibits show the particulars as to the proposed abandonment, and are available for public inspection in the Office of the Town Clerk of the Town of Los Gatos, Civic Center, 170 East Main Street, Los Gatos, California. 2. The existing storm drainage easement along the southerly property lines and the remaining public utility easements along the northerly and easterly property lines shall be retained. 3. On September 4, 1984, in the Council Chambers of the Civic Center, 110 East Main Street, Los Gatos, California, the Town Council will hold a public hearing to consider whether or not the easement is necessary for present or prospective public use. The meeting will begin at 7:30 P.M. All persons interested are invited to attend and be heard. 4. The Town Clerk is authorized, and is hereby directed to publish a copy of this resolution in the Los Gatos Times, a newspaper of general circulation, published and circulated in the Town of Los Gatos, within fifteen (15) days after the date of its adoption. 5. The Mayor of the Town of Los Gatos is authorized, and is hereby directed to execute that document entitled, "NOTICE TO ABANDON A PORTION OF THE PUBLIC UTILITY EASEMENT ALONG THE EASTERLY PROPERTY LINE AT 210 MILBRAE LANE ", a copy of which is attached hereto, and the Director of Public Works is authorized, and is hereby directed to conspicuously post three (3) copies of said Notice, not more than 300 feet apart, on at least ten (10) days before the date of the public hearing above designated. The subject lot is the last undeveloped parcel in the neighborhood and no additional utilities are expected to be required, parti- cularly within the subject easement. Lot 34 has a 12kv PG &E power line in a 101 P.U.E. along the north property line, 201 }_ into Los Gatos Creek. There is a storm drain within a 51 drainage easement along the south property line. There are no utilities within the P.U.E. along the rear of the lot. If it is not possible to abandon all of the easement, we request abandonment of the westerly 10 feet of the easement to accommodate the proposed building.
