A RESOLUTION OF INTENTION TO ABANDON A PORTION OF THE PUBLIC
UTILITY EASEMENT ALONG THE EASTERLY PROPERTY LINE AT 210 MILBRAE LANE
RESOLVED:
1. It is the intention of the Town Council to vacate, under the
provisions of Sections 8300 through 8325 of the Streets and Highways Code,
a public utility easement situated in the Town of Los Gatos, County of
Santa Clara, State of California, consisting of a strip of land
approximately 6 feet wide containing approximately 0.012 acres located
along the easterly property line at 210 Milbrae Lane, and more
particularly described in Exhibit "A" "Description of Excess Portion of a
Public Utility Easement to be Abandoned by the Town of Los Gatos ", and
Exhibit "B" (Plat to Accompany Public Utility Easement Abandonment),
copies of which are attached hereto. Said Exhibits show the particulars
as to the proposed abandonment, and are available for public inspection in
the Office of the Town Clerk of the Town of Los Gatos, Civic Center, 170
East Main Street, Los Gatos, California.
2. The existing storm drainage easement along the southerly property
lines and the remaining public utility easements along the northerly and
easterly property lines shall be retained.
3. On September 4, 1984, in the Council Chambers of the Civic
Center, 110 East Main Street, Los Gatos, California, the Town Council will
hold a public hearing to consider whether or not the easement is necessary
for present or prospective public use. The meeting will begin at 7:30
P.M. All persons interested are invited to attend and be heard.
4. The Town Clerk is authorized, and is hereby directed to publish a
copy of this resolution in the Los Gatos Times, a newspaper of general
circulation, published and circulated in the Town of Los Gatos, within
fifteen (15) days after the date of its adoption.
5. The Mayor of the Town of Los Gatos is authorized, and is hereby
directed to execute that document entitled, "NOTICE TO ABANDON A PORTION
OF THE PUBLIC UTILITY EASEMENT ALONG THE EASTERLY PROPERTY LINE AT 210
MILBRAE LANE ", a copy of which is attached hereto, and the Director of
Public Works is authorized, and is hereby directed to conspicuously post
three (3) copies of said Notice, not more than 300 feet apart, on at least
ten (10) days before the date of the public hearing above designated.

Town of Los Gatos held on 6 day of August , 1984 by the following vote:

To Be Abandoned by the Town of Los Gatos
Lot 34, Tract #1625 (210 Milbrae Lane)
All that certain property situate in the Town of Los Gatos, County of Santa Clara,
State of California, described as follows:
A portion of Lot 34 Tract 1625 recorded in Book 81 of Maps at page 44,
Santa Clara County Records, as corrected by that certain Record of
Survey recorded in Book 82 of Maps at page 37 on August 14, 1957 Santa
Clara County Records, described as following:
Beginning at the most Southerly corner of said Lot 34;
thence Westerly along the Southwesterly line of said lot
North 49 006104" West a distance of 24.09 feet to the true
point of beginning; thence along said line North 49 006104"
West a distance of 6.24 feet; thence along the Northerly
line of that certain public utility easement within Lot 34,
as shown on the Map of Tract 1625 recorded in Book 81 of
Maps at page 44, Santa Clara County Records, as corrected by
that certain Record of Survey recorded in Book 82 of flaps at
page 37 on August 14, 1957 Santa Clara County Records, North
36 006117" East a distance of 86.76 feet to a point on the
Westerly line of that certain 20 foot public utility
easement centered on the Easterly line of Lot 34 of said Map
of Tract 1625; thence Southerly along said Westerly line
South 57 °13'08" West a distance of 5.99 feet; thence South
35 057'04" West a distance of 87.63 feet to the true point of
beginning.

of Los Gatos, County of Santa Clara, State of California, adopted Resolution
No. % :1.; ?entitled, "A RESOLUTION OF INTENTION TO ABANDON A PORTION OF THE
PUBLIC UTILITY EASEMENT ALONG THE EASTERLY PROPERTY LINE AT 210 MILBRAE LANE ",
located along Los Gatos Creek. A copy of said Resolution No./ - , and a
map entitled, "PLAT TO ACCOMPANY OF PUBLIC UTILITY EASEMENT ABANDONMENT ",
showing the particulars as to the proposed vacation are on file in the Office
of the Town Clerk of the Town of Los Gatos, Civic Center, 110 East Main Street,
Los Gatos, California, and are available for inspection during regular business
hours.

Subject: Easement Abandonment, Lot 34, Tract 1625
Dear Gary:
On behalf of our client, Northland Realty, Inc., we are herewith
requesting the abandonment of a Public Use Easement (P.U.E.)
within Lot 34 of Tract 1625, as shown on the accompanying plat.
The subject lot is the last undeveloped parcel in the neighborhood
and no additional utilities are expected to be required, parti-
cularly within the subject easement. Lot 34 has a 12kv PG &E power
line in a 101 P.U.E. along the north property line, 201 }_ into
Los Gatos Creek. There is a storm drain within a 51 drainage
easement along the south property line. There are no utilities
within the P.U.E. along the rear of the lot.
If it is not possible to abandon all of the easement, we request
abandonment of the westerly 10 feet of the easement to accommodate
the proposed building.
