The Town of Los Gatos acquired an easement for sanitary sewer purposes
on or about December 15, 1978 over a portion of Lot No. 2, Tract 6514
recorded on December 15, 1978 at Book 432 of Maps, Pages 36 through 38,
Santa Clara County Records, but the easement has not been used in the
manner and for the period described in Government Code Section 50443(a) or
(b)
A portion of the easement is not necessary for present or prospective
public use at its' present location and it is in the public interest to
vacate said portion and relocate it to a different area on said lot.
NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as follows:
1. The Town of Los Gatos acquired an easement for sanitary sewer
purposes on or about Decernber 15, 1978 and it has not been used for the
purpose for which it was dedicated or acquired for five consecutive years
next preceding the proposed vacation.
2. The portion of the easement described in Exhibit "A" has not been
used during the period from December 15, 1978 to July 2, 1984, and it is
unnecessary for present or prospective use.
3. That portion of the easement described in Exhibit "A" is ordered
vacated. Title to the land previously subject to the easement reverts to
the owner of the land free from rights of the public.
4. The Clerk shall have a certified copy of this order recorded in
the Office of the Recorder of the County of Santa Clara.
PASSED AND ADOPTED at a regular meeting of the Town Council of
the Town of Los Gatos held on 2nd day of July 1984 by the
following vote:

All that certain real property situate in the State of California, County of
Santa Clara, Town of Los Gatos more particularly described as follows:
A 10 foot wide strip of land over a portion of Lot 2 as shown on the
map of Tract No. 6514 filed in Book 432 of Maps at Pages 36, 37 and
30, Santa Clara County Records, the center line of which is described
as follows:
Commencing from a monument at the end of Leotar Court, said monument
bearing N. 10 °29'43" E., 235.00 feet from the intersection of Leotar
Court and Forrester Road; thence from said point of commencement along
a radial bearing of N. 55° 55'10" E., 40.00 feet to a point on the
right -of -way line of Leotar Court; thence along the northwesterly line
of said Lot 3 N. 55 °55'10" E., 57.50 feet; thence leaving said
northwesterly line of said Lot 3 N. 17 000'00" W., 5.23 'feet to the
TRUE POINT OF BEGINNING; thence N. 17 °00'00" W., 239.77 feet to the
point of terminus.
