RECOMMENDATION :

BACKGROUND :
On May 9, 2018, the Santa Clara County Civil Grand Jury issued a report pursuant to its
investigation into circumstances in which law enforcement officers use deadly force against
persons who are in mental health crisis, whether or not they were committing a crime (see
Attachment 1). The key focus of the report was law enforcement mental health training
policies. While the Civil Grand Jury found that major efforts have been undertaken in the
County to train law enforcement officers in recognizing and deal ing with people in mental
health crisis , they concluded there was room for improvement in the following areas:
1. D epth of training
2. Number of officers trained
3. C urrent Crisis Intervention Training (CIT) protocols
4. DeploymentAofA“inAtheAfield”AmentalAhealthA professional teams
The Civil Grand Jury Report directed individual law enforcement agencies to respond to specific
findings and recommendations (Attachment 2 contains the draft Town responses).

DISCUSSION :
The Los Gatos -Monte Sereno Police Department i s included in the Santa Clara County Civil
GrandAJuryAReportAonA“PoliceAandAtheAMentallyAIll.AImprovingAOutcomes”AbecauseAitAisAaAlawA
enforcement agency within the County of Santa Clara and a member of the Santa Clara County
PoliceAChief’sA ssociation:A As a result of its inclusion in the report, the Police Department is
required to respond by letter or electronic transmission to the Civil Grand Jury ’sAFindingsAandA
Recommendations within 90 days , pursuant to California Penal Code 933.05. The Police
Departm ent may respond to the Report’sA F indings in one of the following ways :

attendant Recommendations. The Police Department is required to respond to two of the

CONCLUSION :
Staff recommends approval of the letter with the detailed response as contained in Attachment
2. Once approved by the Town Council , the letter will be transmitted to the Santa Clara County
Civil Grand Jury.
FISCAL IMPACT :
There is no fiscal impact for a pproving the 2018 response to the Civil Grand Jury.
