RESOLUTION DENYING APPEAL FROM PLANNING COMMISSION
DENIAL OF CONDITIONAL USE PERMIT APPLICATION AND
ARCHITECTURE AND SITE APPLICATION
(16845 Hicks Road - Los Gatos Christian Church)
WHEREAS:
1. Tom Moore, Business Administrator of the Los Gatos Christain
church, has appealed a decision of the Planning Commission as follows:
Denial of Conditional Use Permit Application U- 73 -15G and Architecture
and Site Application S- 73 -114E requesting approval of plans to construct
a Youth Sunday School Center, a gymnasium, and the relocation of an
existing home to a new site for property in the HR -1 zone at 16845
Hicks Road; and
2. A public hearing was held on April 2, 1984;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the findings of the Planning
Commission were correct as follows:
a. The proposed use is an intensification of the existing use;
b. The existing use exceeds the traffic capacity of the roads
in the area, in particular, Hicks Road;
C. The area is semi - rural;
d. Sufficient parking is not available on -site;
e. The proposed use would impair the character and integrity
of the zone.
3. The Town Council further finds that intensification of the
use of this property located in the Hillside area is in violation of
the current and proposed General Plans and the policy to protect the
hillsides.
4. The Town Council hereby finds that the decision of the Planning
Commission denying the application was correct.
5. Based on the foregoing findings, the appeal is hereby denied.

6. Pursuant to Los Gatos Town Code Section 1 -15, the time for
seeking judicial review of the Town Council decision is governed by
California Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of
the Town of Los Gatos held on the 16th day of April, 1984 by the
following vote:

Terrence J. Daily, Brent N. Ventura
and Mavor Thomas J. Ferrito
