RESOLUTION DENYING APPEAL FROM PLANNING
COMMISSION DENIAL OF ZONE CHANGE APPLICATION
(14823 Los Gatos Boulevard - Moisenco)
WHEREAS:
1. Warren B. Heid, architect acting on behalf of Mr. and Mrs. A. Moisenco
(Owner) and Dr. Henry Fee (Applicant), has appealed a decision of the Planning
Commission as follows: Denial of a Zone Change Application Z -84 -1 requesting a
change of zone from R- 1:8,000 to "0" in order to develop a medical office build-
ing on the property located at 14823 Los Gatos Boulevard; and
2. A public hearing was held on April 2, 1984.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the findings of the Planning Com-
mission were correct as follows:
a. The current General Plan has a defined need for housing, specifi-
cally rental housing, and there is no defined need for offices in the current
General Plan;
b. The Commission has received information over the last several
months indicating that the Town of Los Gatos has a vacancy rate of 15% to 25% in
its offices.
2. The Town Council hereby finds that the decision of the Planning Com-
mission denying the zone change application was correct.
3. Based on the foregoing findings, the appeal is hereby denied.
4. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review of the Town Council decision is governed by California Code of
Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos held on the 16 day of April , 1984 by the following vote:
