1984-052-Approving Amendments To The Contract With Los Gatos Joint Union High School DistrictRESOLUTION NO. 1984 -52 A RESOLUTION APPROVING AMENDMENTS TO THE CONTRACT WITH LOS GATOS JOINT UNION HIGH SCHOOL DISTRICT BE IT RESOLVED, that the current contract between the Town of Los Gatos and the Los Gatos Joint Union High School District signed by the Mayor on May 26, 1983, is hereby approved for amendment as indicated in the attached Exhibit "A ", and BE IT FURTHER RESOLVED that the Mayor is hereby authorized and is directed to execute said amendment to the contract on behalf of the Town of Los Gatos. RECITALS: 1. On May 26, 1983, Town and District executed an Agreement for Handicap Accessibility Modifications for the Los Gatos High School ( "Agreement "), a copy of which is attached hereto as Exhibit 1 and incorporated by reference herein. 2. The maximum amount for the projects detailed in said Agreement is $30,000. 3. On March 5, 1984, the District determined that $31,572 was the low bid for Phase I of the Handicap Accessibility Project detailed in said Agreement. 4. Town has expended $2,792.26 for architectural fees for said Project from the $30,000 funds allocated to said Project under the Agreement. 5. The Phase II allocation for other projects relating to handicap accessibility modification at the High School is currently $40,164. 6. District has requested the amount of $4,364.26 to be released from the Phase II allocation to cover the current costs of Phase I. AGREEMENT: In consideration of the foregoing Recitals, and of their respective promises herein, the parties agree as follows: 1. The maximum amount which the Town shall provide to District to pay for the cost of the Project, as set forth in Exhibit A of Exhibit 1, shall be $34,364.26. 2. The Town shall transfer $4,634.26 from the Phase II allocation of funds for other handicap accessibility projects to pa_v for the Project detailed in Exhibit A of Exhibit 1. This agreement is entered into pursuant to a program administered by she TOWN for handicap accessibility. The goal of the program is to provide access for the mobility impaired. The purpose of this agreement between the TOWN and the DISTRICT is to establish the responsibilities of each party for the making of agreed upon modifications to Los Gatos High School, (See Exhibit A) located at 19 High School Court, Los Gatos, in return for which TOWN will provide a maximum amount of $30,000 to the DISTRICT to pay for the cost of the project. If more funds are needed, issue will be brought to the Town Council. T`=EFORE, THE TOWN AND DISTRICT AGREE AS FOLLOWS: 1. Architectural Drawings. The DISTRICT agrees tc hire an architect who is qualified to draw the plans for this project. Once the drawings have been finalized and the job is ready to go out to bid, the TOWN agrees to pay the architect within thirty (30) calendar days of approval of the plans and specifications by the TOWN. 31 -1` ,nR. This project is being assisted by the United States of America and must follow all Federal Labor Standards Provisions; however, the DISTRICT shall comply with all applicable state laws. Wherever there is a disagreement between the federal and state regulations, the more stringent regulations or higher wage scale will be observed. The DISTRICT agrees to enclose a complete copy of the Community Development Block Grant Program.- - Federal Labor Standards Provisions (HUD 4010) with all bid packets along with a copy of the complete and most recent Federal Wage Decision. The DISTRICT agrees to contact the San Francisco Area Office (SFAO) Labor Relations Staff ten days prior to bid opening to determine if a wage determination has been modified or. superseded. Contractors must be notified in a reasonable amount of time before bid opening if any modifications have been made that would affect this project. SFSO - Labor Relations should be contacted again prior to contract award to determine if the wage decision has been superseded and to verify the eligibility status of the lowest responsible bidder. Files should be documented noting date contractor was verified and the SFAO staff person who provided the service. (TOWN receives copy of this doc'=entation). Once a bid has been awarded, the TOWN agrees to set up a Pre - Construction Conference with the DISTRICT, the contractor and the County to review Labor Standards and the work contracted., 4 inspection. The DISTRICT will take all necessary steps to assure that the TOWN is permitted to examine and inspect the work to confirm that the work is done in accordance with the plans and specifications, and all contracts, materials, equipment, payrolls and conditions of employment pertaining to the work, including all relevant data. 5. Nondiscrimination. Public Law 93 -383, Title I Sec. 109 (a 7 No person in the United States shall on the ground of race, color, national origin or sex be excluded from participation in, be denied benefits of, or subject to discrimination under any activity funded by this program. Work Justification., No additions or changes are permitted unless prior approval is obtained in writing from the DISTRICT and TOWN. Payment Procedure. The work must be completed and claims for labor and material must be paid, and all Labor Standards must be submitted before payment(s) can be made to the contractor. Before the final payment is made, the TOWN must have received copies of a Waiver of Liens from the contractor, each of his subcontractors, materialmen and suppliers as well as all required Labor Standards material. VAN HOUTEN, DIRECTOR OF PUBLIC WORKS SUBJECT: HANDICAP ACCESS MODIFICATIONS AT LOS GATOS HIGH SCHOOL DATE: FEBRUARY 23, 1983 On February 15, 1983 I met with Jill Cody, Sandy Nusink, Jim Lewis, Dr. Alan Coryell, an other representatives of the high school district to discuss proposed modifications to Los Gatos High School to improve handicap access. Items discussed were the following: 1. Auditorium Revisions. It was decided that three (3) auditorium seats would be removed. Two 2 seats would be removed in front of the center lateral aisle, and one (1) seat would be removed behind the aisle. The seats to be removed are the lst and 2nd seats from the wall on the left side of the auditorium (facing front). 2. Inner -Quad Pavinq Modifications. Pave a level path behind the curved bench a ong t he northwest portion of the inner -quad to provide a level pathway approximately four feet (4') wide to permit wheelchair access across the quad from the lower areas of the high school property to the high school building via the doorway at the southwest corner of the inner -quad. 3. Northwest Science Winq. Take out paving at the corner of the building to establish a relatively level pathway from the behind the science wing in an east -west direction. 4, _Ram Around _Sma_l�l Gym. Construct a separate ramp leading from the existing ground level —at the southeast corner of the small gym west and north along the south and west sides of the small gym to the levels of the existing pavement at the top of the hill. This will probably take out the landscaping along the south side of the small gym. The ramp will follow the edge of pavement in the parking area adjacent to the west side of the small gym. This will require construction of a ramp at maximum gradient with level landings as required railings and retaining walls to support the ramp where it is above grade. it is not absolutely clear that there is enough length in the proposed route to accommodate the necessary difference in elevation between the beginning and end of the ramp. 5. Baseball Field. A ramp is needed to get from the main parking lot on New Yori Avenue down to the level of the baseball field and bleachers behind it. A platform and ramp is also needed to provide a space for handicap people io .patch baseball games. The platform would be behind the existing wood retaining wall just west of the bleachers. There are 2 alternatives to provide the ramp from the parking lot to the level of the playfield. One involves regrading the driveway down to the playfield and paving a pathway north of the batting cage to the bleacher area. The other is constructing a separate path possibly across the area occupied by the present par course station (and relocation of the par course station). The alternative which is the most economically feasible would probably be selected. Page 2 David R. A ramp is also needed to provide access to the north softball field through the gate from the Los Gatos Lodge property. 7. A ramp is needed from the outdoor baseketball court north of the library wing to the softball field . The new ramp will have to begin at the basketball court but may not encroach into it. Presumably this will require construction of new ramp, outboard of the existing path, and possibly outboard of the first Oak tree. I proposed to contact Dennis Burrow regarding this work, go over the estimated cost of the work with him, and get some sort of an estimate as to what his fee would be for preparing plans and specifications for doing this work.
