RESOLUTION REFERRING TO PLANNING COMMISSION
THE APPEAL FROM PLANNING COMMISSION DECISION
DENYING ARCHITECTURE AND SITE APPLICATION
(234 Los Gatos Boulevard - John Scott)
WHEREAS;
1. John Scott has appealed a decision of the Planning Commission as
follows: denial of request for approval of exterior modifications to an
office building located in the "0" Zone at 234 Los Gatos Boulevard (Architecture
and Site Application S- 0- 105B); and
2. A public hearing was held by Council on November 21, 2983;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the findings and decision of the
Planning Commission, in part, were based on Appellant's failure to appeal at
Planning Commission meetings at which his application was to be considered;
2. The Council further finds that Appellant's request should be examined
on its merits by the Planning Commission.
3. The Council further finds that the Appellant stipulated to the
referral of this matter to the Planning Commission.
4. Based on the foregoing findings, the appeal is referred to the
Planning Commission to consider the Appellant's Architecture and Site
Application on its merits.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos held on the 5th day of December, 1983, by the following vote:
