RESOLUTION GRANTING APPEAL FROM PLANNING COMMISSION DECISION
(15732 Los Gatos Boulevard - Round Table Pizza, Inc.)
WHEREAS:
1. Barron A. McDonald has appealed a decision of the Planning
Commission as follows: approval of a request for permission to operate a
pizza parlor, with sale of beer and wine for consumption on the premises on
property located at 15732 Los Gatos Boulevard in the E1 Gato Shopping Center
(Round Table Pizza, Inc. Conditional Use Permit Application U -83 -20 and
Architecture and Site Application S 83 -34);
2. A public hearing was held by the Council on November 21, 1983;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the findings and decision of
the Planning Commission were incorrect as follows:
a. Failure to consider extensive and additional trip generation
that will come from the particular usage and the negative impact on traffic
in the immediately adjacent residential area;
b. Failure to consider the significance of the impact of said
traffic on the major arteries that surround the particular location; and
c. Failure to consider the parking deficiency existing at said
shopping center.
2. Based on the foregoing findings, the appeal is granted and Condition
Use Permit Application U -83 -20 and Architecture and Site Application S -83 -34
are hereby denied.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos held on the 5th day of December, 1983, by the following vote:
AYES: COUNCIL MEMBERS Eric D. Carlson, Terrence J. Daily and
Mayor Thomas J. Ferrito
