RESOLUTION GRANTING APPEAL FROM PLANNING COMMISSION
(16055 and 1.6085 Camino del Cerro - Gordon Levin)
WTMEAS:
1. Gordon Levin has appealed a decision of the Planning CcMnission as
follows: approval of a Certificate of Compliance on Subdivision Application
M- 77 -5A; and
2. A public hearing was held on September 6, 1983; a field trip by the
entire Town Council to the subject property occurred on September 12, 1983; and a
continued public hearing was held on October 17, 1983;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission erred by failing
to consider the following:
a. that Mr. Carstens created the current problem;
b. the impact that approval would have on the current zoning ordinance,
c. other things that Mr. Carstens could do with the property other than
develop it;
d. the fact that the parcel does not meet current zoning standards; and
e. the fact that the access is not owned in fee.
2. Based on the foregoing findings, the appeal is granted, and the applica-
tion for a certificate of compliance is denied.
PASSED AND ADOPTED AT A REGULAR. MEETING OF THE TOWN COUNCIL OF
THE TOWN OF LOS GATOS this 7th _ day of November 1963, by the
following votes:
