1983-142-Denying Appeal From Decision Of Building Official-Jack In The BoxRESOLUTION NO, 1983 -142 RESOLUTION DENYING APPEAL FROM DECISION OF BUILDING OFFICIAL 15771 Los Gatos Blvd Jack -in- the -Box) 1. Food Maker, Inc. has appealed a decision of the Building Official, as follows: requiring provision of handicapped access on an existing building in connection with remodeling; and 2. A public hearing was held by the Town Council on June 20, 1983; IT IS HEREBY RESOLVED: 1. The Town Council hereby finds as follows: a. The subject building receives intensive public use and therefor requires handicapped access. b. In contrast to shopping centers, where other restrooms with access may be available close by, this facility stands by itself, c. Since the facility invites handicapped people in as patrons, it should also provide restroom accommodations for such patrons. d. In view of the foregoing considerations, the cost of providing handicapped access is not unreasonable in comparison to the cost of the remodeling, and the decision of the Building Official was therefore correct. 2, Based on the foregoing findings, the appeal is denied.
