1983-138-Approving The Annexation Of Certain Uninhabited Territory Designated As Deer Park Road No. 1 To The Town Of Los GatosRESOLUTION NO, 1983-138 A RESOLUTION APPROVINI—TREMMATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS DEER PARK ROAD NO. 1 TO THE TOWN OF LOS GATOS 7)Ezw"Pf�' Qw- WHEREAS, on June 17, 1933 , the Local Agency Formation Commission of the County of Santa Clara, State of California, pursuant to a petition signed by all the owners of land within the territory to be annexed, approved the annexa- tion of that hereinafter described area, designated as Deer Park Road No, I to the Town of Los Gatos and, by their Resolution No. 83-29, directed the Town Council of the Town of Los Gatos to initiate proceedings to annex said territo- ry without notice, hearing, or election, in the manner described in Section 35227 of the Government Code of the State of California, and made the following findings: T. The project is categorically exempt from CEQA Class #75119(a). 2. The territory is "Uninhabited" as defined in Section 35038 of the Gov- ernment Code of the State of California; and WHEREAS, the Town Council finds that the findings of the Local Agency For- mation Commission in Resolution 83-29 are correct, and the territory proposed for annexation is situated in the unincorporated area of the County of Santa Clara, and is contiguous with the municipal boundaries of the Town of Los Gatos, RESOLVED, by the Town Council of the Town of Los Gatos, a municipal corpo- ration of the County of Santa Clara, State of California, that pursuant to the provisions of Sections 35757, 35221, and 35234 of the Government Code of the State of California, the annexation to the Town of Los Gatos of that territory designated as Deer Park Road No. I , and described in real property description and map attached hereto, marked Exhibits "Au and M, respectively, is approved, and that the same be annexed to the Town of Los Gatos. FURTHER RESOLVED, that upon completion of these annexation proceedings the territory annexed will be taxed in Town of Los Gatos Tax Rate A, including tax- es for existing bonded indebtedness. -2- FINALLY RESOLVED, that the Town Clerk is authorized, and is hereby directed, pursuant to Section 35350 of the Government Code, to prepare under seal a certified copy of this resolution, giving the date of passage, and imme- diately transmit same along with a remittance to cover the fees required by Section 54902.5 of the Government Code to the Executive officer of the Local, Agency Formation Commission of Santa Clara County.
