RESOLUTION UNDER EDUCATION CODE SECTION 39397
REGARDING INADEQUACY OF PUBLIC LANDS IN THE VICINITY OF BERRY SCHOOL
WHEREAS: The 1965 Parks Bond Election culminated the Town's planning ef-
fort to acquire park lands to fulfill the Town's needs for parks and
recreation. One of the major principles of this plan was to locate parks adja-
cent to school sites wherever possible. This was done for two reasons, (1) to
create a community focus for the various neighborhoods and (2) to avoid duplica-
tion in the types of facilities provided on the school grounds and in the parks.
WHEREAS: Generally it has been the Town's practice to not build hard court
areas (except tennis courts) in the parks and to not have formal multi -use ball
fields intended for baseball, football, soccer, etc. It is interesting to note
that there is a growing demand for fields for organized team sports (baseball,
football, soccer) that is in contrast to the declining school enrollment.
WHEREAS: In 1965 there were 10 schools or proposed school sites in the
Town and three parks were proposed and later acquired adjacent to school sites.
Since then two school sites adjacent to parks sites (Worcester and Rinconada)
have been sold for development as single family homes. In addition, three
schools have been closed (Mirassou, Howes and Berry) but only Berry has been de-
clared surplus. Mirassou and Howes are in the Union School District and
currently there is not any benefit for the District to declare them surplus. In
fact, there may be a detriment since the District has not paid back all of its
State loans.
WHEREAS: There are no other publicly -owned hardcourt or multi -use playing
fields within a half -mile radius of Berry School and the only such facilities
within a mile radius are at Carlton School in San Jose and Capri School in
Campbell. If either of these schools were closed and declared surplus by their
respective districts (Capri in Campbell District and Carlton in Union District)
the Town would not be able to control the disposition of the sites.
RESOLVED, by the Town Council of Los Gatos, that pursuant to Education Code
Section 39397, the Council hereby finds that public lands in the vicinity of the
Berry School site are inadequate to meet the existing and foreseeable needs of
the community for playground, playing field, or other outdoor recreational and
open space purposes,
PASSED AND ADOPTED at a regular meeting of the Town Council of
the Town of Los Gatos held on the 2nd day of May 1983, by
the following vote:
