RESOLUTION GRANTING APPEAL FROM DECISION OF BUILDING OFFICIAL
(13 N. Santa Cruz - Idamina's Fashions)
WHEREAS:
1. Geraldine A. Fowler has appealed a decision of the Building Official,
as follows: requiring provision of handicapped access on an existing building in
connection with remodeling; and
2. A public hearing was held by the Town Council on March 7, 1983;

1. The Town Council hereby finds as follows:
a. The subject building is a building which existed prior to the
adoption of 24 California Administrative Code Section 2- 105- 11A(5).
b. The total cost of the proposed addition does not exceed the
valuation threshold in Section 2 -105.
c. Full compliance with sub - Section 17A(5) would create an unreasonable
hardship for the following reason: the cost of compliance would be approximately
100% of the cost of the addition.
d. Compliance with certain other access requirements, listed below,
would not constitute an unreasonable hardship.
2. Based on the foregoing findings, the appeal is granted, and the
Building Official is authorized to issue a building permit without requiring full
conpliance with sub - Section 11A(5), provided that the following condition is met:
grab bars shall be installed in all sanitary facilities.

OF THE TOWN OF LOS GATOS THIS 21st day of March , 1983, by the
