1983-049-Agreement For Professional Services Re: The Noise Element Of The Draft General PlanRESOLUTION NO. 1983 -49 RESOLUTION AUTHORIZING AGREEMENT FOR PROFESSIONAL SERVICES RE: THE NOISE ELEMENT OF THE DRAFT GENERAL PLAN RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara, State of California, that the TOWN OF LOS GATOS enter into that agreement for professional services to be used in the preparation of the Noise Element of the General Plan with Environmental Consulting Services, a copy of which is attached hereto, and that the Mayor is authorized, and he is hereby directed, to execute said agreement in the name and in behalf of the TOWN OF LOS GATOS. The TOWN desires to contract for the performance of Environmental Services for professional services to be used in the preparation of the following project: Noise Element of the General Plan 2. The CONSULTANT is willing to perform such professional services upon the terms and conditions herein set forth: THE PARTIES DO HEREBY AGREE AS FOLLOWS: SERVICES 1. CONSULTANT shall perform those professional services described in the "Scope of Services" and "Schedule of Delivery" attached as "ATTACHMENT A." Scheduling will depend on factors beyond (but not limited to) prompt submittal of weather conditions, delay caused by alte etc. CONSULTANT will diligently perform the schedule outlined above but will not his control. COMPENSATION CONSULTANT'S control including required data by the TOWN, adverse ~ation in the scope of the project, the required services according to be responsible for delays beyond 2. Compensation for CONSULTANT'S professional services shall be at a firm fixed price of $ 1,400.00. Payment to be made in accordance with Scope of Services and Schedule of Delivery as stated in ATTACHMENT A. STANDARDS 3. Box 949 Los Gatos, California 95031 or personally delivered to client at such address of such other as TOWN may designate in writing to CONSULTANT. Provide traffic noise profile matrix and an explanatory report covering the measurements, the use of the profile matrix and contour validation $ 1,000.00 2. Monitoring program for checking contours at selected locations (5 - 7 measurement locations) $ 400.00 per day The consultant shall bill the Town for services completed. For any work required by the Town beyond that described in Attachment A, payment, at a rate of $55.00 per hour, shall be made upon completion of the work and receipt of the bill. SCHEDULE OF DELIVERY: Work shall commence as soon as Agreement is signed by both parties and be completed within 30 days.
