1982-226-Granting Appeal From Decision Of Building Official Re Handicapped AccessRESOLUTION NO. 1982 -226 RESOLUTION GRANTING APPEAL FpaOl DECISION OF BUILDING OFFICIAL RE HANDICAPPED ACCESS (15861 Winchester Blvd. - Drs. Don McCleve, et al.) 1. Dr. Don McCleve and others have appealed a decision of the Building Official, as follows: requiring existing restrooms to be modified to comply with Title 24 handicapped access requirements; and 2. A public hearing was held by the Tani Council on November 15, 1982; IT IS HEREBY RESOLVED: 1. The Town Council hereby finds as follows: a. The total construction cost of the proposed alterations does not exceed a valuation threshold of $50,000 adjusted as provided in Section 2- 104- 11A(6) of Title 24, California Administrative Code. b. Compliance with the full requirements of Section 2- 105- 11A(5) would create an unreasonable hardship, as follows: (1) The alteration does not involve any intensification of use. (2) Bringing the restrocros into compliance will cost approximately $11,000, which is excessive in relation to the $14,000 cost of the alterations. (3) Bringing the restroans into compliance can only be acccaTlished by eliminating one restroom and thereby allowing only one restroom for both sexes, which is undesirable. 2. Based on the foregoing findings, the appeal is hereby granted, and the Building Official is directed to require compliance with all aspects of Title 24 except those dealing with sanitary facilities.
