RESOLUTION DENYING APPEAL OF DECISION OF
BUILDING OFFICIAL BUT ALLOWING DEFERRAL OF IMPROVEAENTS
(133 North Santa Cruz Avenue - Brunello)
1. Roger Brunello, dba Le Boulanger, has appealed a decision of the Building
Official, as follows: requiring provision of handicapped access on an existing
building in connection with remodeling; and
2. A public hearing was held by the Council on October 25, 1982;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Building Official's decision was
correct.
2. The Council further finds that it would be equitable to allow the appellant
one year to bring his existing building into compliance with handicapped access laws.
3. Based on the foregoing findings, the appeal is denied, and the Building
Official is authorized to issue a building permit to appellant upon his execution of
an agreement to bring the existing building into compliance with handicapped access
laws within one year from issuance of the permit, said agreement to be in a form satis-
factory to the Town Attorney, and upon compliance with all other Town laws and ordinances.
