RESOLUTION GRANTING APPEAL OF DECISION
OF BUILDING OFFICIAL
(208 Bachman - C. B. Hannegan's)
C. B. Hannegan's has appealed a decision of the Building Official,
letter from Archie Watson to Chris Benson dated February 10, 1982,
stating handicapped access requirements; and
2. A public hearing was held by the Town Council on September 20, 1982;
IT IS HEREBY RESOLVED:
1. The Council hereby finds as follows:
a. The outside ramp as constructed complies with ASA specifications.
b. The aforesaid ramp constitutes a primary entrance.
c. While the different elevations are not connected by an inside
ramp, the practical difficulty of providing handicapped access for an already -
constructed building warrants an exception from the literal requirements for
an inside ramp, and the outside ramp provides equivalent facilitation and
protection.
2. Based on the foregoing findings, the appeal is hereby granted, and
the as -built ramp is approved as a substitute for the hydraulic lift contained
in the remodeling plans, subject to inspection by the Building Official for com-
pliance with other applicable codes.
