RESOLUTION DEFINING "RETAIL" AND 'OFFICE" AS
USED IN TABLE 33 -A OF THE UNIFORM BUILDING CODE
WHEREAS:
1. In Section 7.02.010, the Town has adopted the 1979 edition of the
Uniform Building Code, including Chapter 33 thereof; and
2. Table 33 -A of the 1979 UBC imposes different standards for handicapped
access and exits depending on whether the use is 'offices" or "stores - retail
salesrooms," but does not define the respective terms; and
3. In order to apply the UBC fully, the Council has determined that it
is necessary to adopt a uniform definition of the aforesaid terms, and for the
sake of consistency, to adopt definitions analogous to those in the Town Zoning
Ordinance;
THE TOWN COUNCIL THEREFORE RESOLVES:
1. The term "Stores - Retail Sales" as used in Table 33-A of the UBC shall
be defined as follows:
a. Retailing as defined by example in §4.54.020 of the Zoning Ordinance,
and including any use which collects any retail sales tax.
b. Personal service businesses and service businesses necessary for the
conduct of households, as defined in §4.54.020 of the Zoning Ordinance.
2. The term 'Office" as used in Table 33 -A of the UBC shall be defined as
follows:
The uses listed in §4.52.020(1) of the Zoning Ordinance.

Council of the Torn of Los Gatos this 17th day of May by
the following votes:
