RESOLUTION GRANTING APPEAL
FROM PLANNING CavMIISSION
(15466 Los Gatos Boulevard - Los Gatos Village Square)
WHEREAS, Jack E. Bariteau has duly and regularly filed an appeal with
the Town Council, from a decision of the Town Planning Commission as follows:
Denial of Conditional Use Permit Application U -81 -12 and Architecture and Site
Application S- 81 -2A; and
WHEREAS, a public hearing was held by the Town Council on April 19, 1982;
BE IT RESOLVED:
1. The above - entitled appeal is granted.
2. The Council hereby makes a negative declaration for the project.
3. The conditional use permit application is approved, on condition that
a signal be installed at the intersection of Los Gatos Boulevard and the driveway
entrance to the Center, subject to approval of Public Works, and synchronized with
the signal at Gateway Drive.
4. The architecture and site application is referred to the Development
Review Cmcnittee for recommendations on the following matters, with a report back
to the Council:
Burger Pit.
a. Reverse the driveway location in accordance with Plan A.
b. Place the building back from the street to allow access to the
c. Revise the landscape plan to include more conifers along the street.
d. Relocate the trash enclosure currently shown in the center of the
parking lot to either the northeast or southwest corner.
e. leave the existing spruce tree in the median island.
5. The Council hereby finds that the Planning Commission erred in the
following respects:
a. Not considering the importance of expanding the Town's tax base.
b. Overemphasizing the impact of a signal on Los Gatos Boulevard.
c. Overestimating the impact of traffic from the center on the
capacity of Los Gatos Boulevard.
PASSED at a regular meeting of the Town Council of the Town of Los
Gatos held on the 3rd day of May 1982, by the
following vote:
