A RESOLUTION DENYING AN APPEAL FROM A DECISION
OF THE TOWN PLANNING COMMISSION
WHEREAS, Gary Maxhimer has appealed a decision of the Town
Planning Commission to the Town Council, as follows: Architecture
and Site Application 5 -81 -4, imposing conditions as to road widening
and grading around or removal of certain trees, on approval of the
construction of a single- family dwelling on top of the hill road; and
WHEREAS, a public hearing was held by the Town Council on
September 8, 1981;
BE IT RESOLVED:
1. The Commission erred in its decision as follows: Not
requiring enough replacement trees.
2. The approval is modified to add a condition that any trees
removed from the Johnson property be replaced one - for -one, subject
to approval of the Parks Superintendent.
3. The appeal is denied on the following grounds: The same
grounds as stated by the Commission.

THE TOWN COUNCIL OF THE TOWN OF LOS GATOS THIS 21st day of
SEPTFMBER , by the following votes:

Brent N. Ventura and Peter W. Siemens
NOES: COUNCIL MEMBERS: None
ABSTAIN: COUNCIL MEMBERS: Marlyn J. Rasmussen
