A RESOLUTION AFFIRMING A DECISION OF
THE TOWN PLANNING COMvIISSION
WHEREAS, Nelson -Moles Development Company has duly and regularly filed
an appeal with the Town Council, from a decision of the Town Planning Commission
as follows: Finding that the Town is not estopped to determine that Architecture
and Site Application S -80 -8 for an office building at 416 San Benito Avenue.
KIEREAS, a public hearing was held by the Town Council on July 6, 1981.
WHEREAS, the Town Council had determined that the decision of the Town
Planning Commission should be affirmed.
BE IT RESOLVED:
The decision of the Town Planning Commission, is affirmed, based on the
following findings:
1. The Town made no affirmative representation.
2. 'The applicant did not reasonably rely on any action by the Town;
therefore the appeal is denied.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos this 6th day of July, 1981, by the following votes:
