DOCUMENT E DESCRIPTION OF COMMUNITY TRANSIT SERVICE 1. Service and Operations Description (a) The Transit ASSIST Program is operational within three geo- graphically contiguous jurisdictions. The primary service area is within the incorporated boundaries of the cities of Saratoga and Monte Serene and the Town of Los Gatos. Currently, service is not provided to the unincorporated areas of the County. The cooperating jurisdictions are located at the base of the Santa Cruz Mountains. To date, service to this mountainious and less densely populated area has not been feasible given existing program resources. Additionally, Santa Clara County Transit has recently began service to this area. Transit ASSIST Service Areas include three zones: A. the geographical boundaries of the Town of Los Gatos and the cities of Monte Serene and Saratoga; B. an area .2 of a mile outside zone A, to include Good Samaritan Hospital, and C. an area not to exceed 10 miles from the geographical center of zone A. Zone C rides must be for medical purposes, and shall be scheduled so as to maximize their efficiency. Fares for zones A and B shall be .504 per ride, for zone C a one way ride will be $1.00. (b) The Los Gatos - Saratoga Transit ASSIST Program (ASSIST) is a demand responsive (within 48 hours) paratransit service currently utilizing one 15 passenger, handicapped accessible (rear Tommy Lift, including tie downs) van. Acquisition of an economy station wagon is planned prior to the beginning of FY 1981 -82. This ' acquisition has been approved by the participating jurisdictions and funds are currently available. Subsequent approval has been granted by the Executive Committee of the Santa Clara County Para - transit Coordinating Council and endorsed by the Saratoga Area Senior Citizen Coordinating Council. Subsequent to acquisition of the station wagon, ASSIST will provide two service modes: 1 - a wagon shuttle service, with an anticipated shortened response time; and continuation of the maximum use concept for the van, inclusive of special service to the handicapped, especially those confined to wheelchairs. Reservations for ASSIST service are requested to be made 48 hours in advance so as to maximize the efficiency of program resources. Ride reservations are made by a phone call to the Program Scheduler and Coordinated with a "destination calendar" (see Transit ASSIST brochure attached). Emergency and special need situations are given priority as they arise. Medical purpose trips are the top program priority. -2- (c) The ASSIST program is operational Monday through Friday (certain holidays excepted), from 8 a.m. to 5 p.m. The ASSIST program will provide door -to -door service with the van driver escorting passengers to and from the outside entrances of the buildings at the origins and destinations of their trips. (d) In order to meet Article 4.5 Farebox requirements, ASSIST riders are charged .50fi for one way rides within zones A and B (see 1(a) above), and $1.00 for a one way ride (medical purpose only) within zone C. (e) As of March 1981, the ASSIST fleet consists of one 15 passenger, handicapped accessible maxi -van. An economy station wagon is to be acquired prior to the beginning of FY 1981 -82, it has been determined, as a result of prior program operation, that this vehicle will provide increased system accessibility to the greatest percentage of ASSIST ridership, i.e., the elderly while the van will remain available to accommodate the disabled and the Beverly handicapped. (f) ASSIST will continue to cooperate with other cities within Santa Clara County and the County Transit system to coordinate service delivery to the transportation deficient residents of Santa Clara County. The cities of Saratoga and Monte Sereno and the Town of Los Gatos have cooperated in providing a con- solidated service and TDA claim. These jurisdictions will continue to pursue service provision to those in need with the same enthusiasm as has been evidenced in the past. 2. Description of Unmet Need (a) Description of Existing Service. The currently existing transit system consists primarily of a bus fleet operated by the Santa Clara County Transportation Agency. Additional sources of transportation include taxi service operated by Yellow and Alpha Cab Companies and a volunteer ride program operated by West Valley ASSIST and Santa Clara County Economic and Social Opportunities, Inc. (ESO). ASSIST service (below) compliments the currently existing service and addresses wide gaps in both geographical service as well as transit service accessibility by those that are currently transportation deficient. The ASSIST Program is a demand responsive paratransit service currently utilizing one 15 passenger, handicapped accessible maxi -van and a soon to be acquired economy station wagon. The program has been active for two years and recieves TDA 4.5 funding. The ASSIST program is a consolidated, coordinated and cooperative effort between the Town of Los Gatos and the cities of Saratoga and Monte Sereno with actual program service provided by West Valley A.S.S.I.S.T., a non - profit corporation. -3- Overall program coordination and consolidation efforts on a Countywide level are enhanced by the cities participation as members of the Santa Clara County Paratransit Coordinating Council and various subcommittees thereof. Due primarily to higher than average jurisdictional populations of elderly and handicapped persons and the lack of effective private taxi service to the West Valley (of Santa Clara County) area, the participating jurisdictions identified a need for expanded transit service to those persons who could not effectively utilize the existing public transit system and either for physical or economic reasons, their own transpor- tation, if such existed. (b) The ASSIST program provides direct transportation service to those members of the community who are transportation deficient. Primary transportation deficiency within the claimant communities exist among the elderly, and the program is structured to meet this need while maintaining service capability to the (much lower by both percent and number) disabled population. Therefore, the ASSIST system accessible to both the elderly (primary ridership) and the handicapped. (c) The primary population to be served by the transit ASSIST program are the elderly (age 60 +) and disabled residents of the community. Following are the number and percents of elderly and handicapped persons residing within Saratoga, Los Gatos, and Monte Sereno as identified in the Santa Clara County 1975 Special Census: (d) The ASSIST Program is designed to meet the needs of trans - portation deficient elderly and disabled residents of the area. ASSIST will carry only passengers who are senior citizens or who are physically handicapped and in either case, who reside in Service Zone A. Senior citizens are persons who are 60 years old or older. A functional definition of a handicapped /disabled person, as stated in the BAY REGION TRANSIT OPERATORS' DISCOUNT FARE PROCEDURE FOR HANDICAPPED PERSONS (12/75) is as follows: A mass transportation handicap is any incapacity or disability which results in the inability of a person to perform one or more of the following functions. 1) Negotiating a flight of stairs, escalator or ramp 2) Standing while waiting for a public transit vehicle 3) Boarding or alighting from a public transit vehicle 4) Standing in a moving public transit vehicle 5) Reading informational signs 6) Hearing announcements by train conductors, bus drivers or station agents 7) Walking more than 200 feet The Eligibility Criteria (definition of handicap) were developed based on a person's ability or inability to use mass transportation services and presume a level of personal mobility and independence to the degree that use of public transportation systems would be a reasonable expectation. 3. Service Coordination (a) ASSIST has arranged to coordinate with existing paratransit services provided within the geographical boundaries of the service area, such as the Senior Escort Services, Inc., a volunteer driver transportation system that coordinates with private taxi companies, the Live Oak Nutrition Program that utilizes volunteer drivers to bring senior citizens to their nutrition center; and West Valley College's Handicapped Transit Program that provides rides for handi- capped students. The Transit ASSIST program operates with input from service recipients and organizations such as the Saratoga Area Senior Coordinating Council, Los Gatos- Saratoga Senior Citizens, Inc., Los Gatos Recre- ation Department's Senior Activities program and the Independent Order of Odd Fellows, i.e. Fellowship Plaza, 150 units of rent sub- sidized senior and handicapped housing. In addition, ASSIST provides coordination and linkage between existing paratransit resources and handicapped accessible Santa Clara County Trnasit District route stops. Staff from Los Gatos, Saratoga and ASSIST will participate on the Santa Clara County Paratransit Coordinating Council and the 4.5 sub - grantee committee thereof, thereby allowing for maximum coordination of paratransit service within Santa Clara County. -5- (b) City and Town staff participate with the Santa Clara County Paratransit Coordinating Council with a primary objective of es- tablishing common service images and facilitating methods of total service delivery, i.e., computerized scheduling, client information and data systems development, paratransit program(s) outreach and advertising, group purchase of capital equipment, group purchase of capital equipment and the development of other feasible methods of coordinations, including specification development for handicapped accessible vehicles and target popu- lation description and analysis. The Transit ASSIST Program evidences a high degree of program coordination in the consoli- dation of three jurisdictions in a 4.5 claim. (c) The ASSIST Program is developing and evolving into an effective and efficient community paratransit service. Continuing efforts in scheduling and response time and evidencing a higher degree of ridership and program satisfaction. The ASSIST Program will continue to be an active participant in cordination efforts as they are defined and developed by the Paratransit Coordinating Council. (d) The ASSIST Program compliments currently existing West Valley (Santa Clara County) transit services. Attached Document E -3 (Short Range Plan - Service Improvement Plan and 516 Program Implementation) depicts the Santa Clara County Transportation Districts (SCCTD) intent to implement system improvements. While complimentary to the current SCCTD system, planned short range improvements add little to service capacity in the Los Gatos/ Saratoga area, especially as they may relate to those that are transportation deficient. The program provides additional needed transportation resources to a geographical area of the County that is not adequately serviced. The ASSIST Program will neet the special needs of the elderly, handicapped and other transpor- tation,deficient members of the community. ASSIST is entirely compatible with the SCCTD system, inclusive of planned improvements. The ASSIST Program has been developed to provide latitude for pro- gram flexibility in cooperation and coordination with existing and future transit providers, be they public or private. Once again, City(s) and Town, as well as ASSIST staff participation on, and with, the Santa Clara County Paratransit Coordinating Council provide for a maximum of public service compliment. 4. Claimant's Management Information System (a) Transit ASSIST tickets may be purchased at the Town Clerk's of- fice of the Town of Los Gatos, 110 E. Main St., or they may be pur- chased at the City Clerk's office of the City of Saratoga, 13777 Fruitvale Ave. If a client is unable, for any reason, to purchase tickets at these two locations, the client may buy the tickets from the Transit Assist driver. The Transit Assist Scheduler then deposits any ticket revenue received from the driver with the Town Clerk of Los Gatos. Redemption of tickets is done solely by the Transit Assist driver, the tickets are logged and turned in to the Transit Assist Scheduler for processing. (b) The Town Clerk's office of the Town of Los Gatos has a client book where they record the number of tickets each participant pur- chases during the month. All revenue is posted monthly on the Revenue Ledger for the program (fund #10492). All expenditures are posted on the Expenditure Ledger and then the Expenditure Ledger is posted to the General Ledger of the Town, thereby creating a good audit tract whereby all funds are accounted for. (c) Transit ASSIST's management information system not only includes what is required by the MTC Quarterly Report, (operating costs, passen- gers carried, vehicle service hours, vehicle service miles, employees), but Transit ASSIST also considers in their program evaluation: 1) How well they are meeting the farebox recovery requirement, 2) The West Valley ASSIST board does periodical program reviews,3) The Community Services and Development Commission of the Town of Los Gatos monitors the program's operating statistics monthly, and 4) Community response to the program is also heavily considered. 5. Claimant's Marketing Program (a) Transit ASSIST, is one of only two Paratransit Programs available in the West Valley. The other, West Valley ASSIST, implements volunteer drivers to transport clients to necessary appointments. This being the case, Transit ASSIST does not experience marketing problems other agen- cies do. Perhaps the best marketing procedure /tactic there is is word of mouth. Hearing from a peer that a transportation program is dependable and efficient is a highly productive means for marketing a program. Transit ASSIST uses a number of procedures to publicize its program: 1) group presentations, 2) inter - agency referrals, 3) program descrip- tion flyers /schedules (Attachment one),4) walk -in traffic at office in Neighborhood Center. 1) Group Presentations: Transit ASSIST coordinator speaks at var- ious organizations in an effort to promote the program. Among those areas of highest visibility is local, nutritional sites, Coordinating Council attendance with local seniors, various club meetings, etc. 2) Inter- agency referrals: Various groups will call Transit ASSIST for information and referrals. Among these are Social Workers, Nurses, Information /Referral specialists, etc. 3) Program description flyers /schedules (attached). This year we launched a large -scale publicity effort in the form of a mail -out of the attached schedules. This has been a most effective means of information delivery to everyone we serve and those we would like to serve. 6 -7- 4) Walk -in traffic at the office in the Neighborhood Center: As we are housed in the new Downtown Neighborhood Center, many people learn of us through the front office here, and we meet those potential riders directly. (b) Transit ASSIST will be in operation for one year this coming April. Thus far, it is clear that our efforts have been suc- cessful. Above, a detailed plan has been outlined. Looking to the future, we will continue as we have and work toward more group events for organizations. This would increase farebox recovery as well as aid in program marketing. Service Contracts A copy of the current Transit ASSIST /Town of Los Gatos service con- tract and a copy of the current Joint Powers Agreement between the Town of Los Gatos and the City of Saratoga is attached. Please note the current agreements are in force and due to expire 6/30/81. 7. Capital Budget Provisions ( The combined Los Gatos, Saratoga, Monte Sereno TDA 4.5 claim for FY 1981 -82, includes only one capital item, an accessi e v /bus to replace the existing program van (as per MTC taff reco endation, letter from P. Piras, Senior Plannerd'ated 2/23/8 ,, and action taken by MTC Grant Review and allocations Committee GR & AC) at their meeting on 3/21/81,- "Agenda Item 7 -b) in the amount-,,,of twenty -five thousand ($25, 6.00) dollars. West Valley SIST, the ansit ASSIST Program operators currently provide a volunteer s ride program that compliments the 4.5 funded Transit ASSI ef- fort. SERVICE IMPPCVEMENT PLAN The Service Improvement Plan for FY 79 -80 includes two elements: .Level of Service Improvements: The second -stage expansion towards implementation of the 516 Plan. .Productivity and Schedule Reliability Improvements: Designed to make existing lines operate more effectively. 616 Program implementation 516 Plan and Schedule County Transit is pursuing the implementation of expanded transit service according to the adopted 516 Bus Plan. This plan calls for the acquisition of 300 new buses and the phasing in of new service over the next two years. The plan includes three elements: 1. Increased frequency of service on existing, heavily utilized lines. Peak headways will be cut in half on many lines with ..most running at 15 minutes or less. 2. Install new lines operating at peak headways of 15 or 30 minutes, with these new lines, transit service will be provided on nearly all main arterials in the county. 3. Implement an express bus system. This express system will provide regional express routes and several direct commuter lines designed to serve the dispersed industrial parks of Santa Clara County. The 516 Plan will be implemented in three stages. The first stage (100 buses) is now underway. The second stage will increase the fleet to about 400 coaches, the yard capacity following the opening of the Agnews Division. The final stage, bringing the fleet up to 516 coaches, is scheduled for completion in 1981. This final stage is dependent on the opening of the New Central facility. The fleet expansion will be approximately as follows: FY 1978 -79 90 buses FY 1979 -80 50 " FY 1980 -81 110 " FY 1981 -82 50 " First Stage Expansion During FY 78 -79, the first stage expansion began. This first phase included an expansion of the fleet to 330 buses, with about 100_ new _buses . placed -into service. The improvements, which are detailed in the 78 -79 PIP include headway reductions on 8 routes 9 new routes and 4 new express routes. These improve- ments are scheduled for completion by October, 1979. _ -36- Second Stage Expansio' The Second Stage Expansion will increase the fleet to about 400 coaches, an increase of about 70 over the First Stage. Recom- mended priorities for this phase are based on the following: 1. 516 Plan for routes and headways 2. Specific requests for new service 3. Rider preferences (based on ridership survey) 4. General community preferences 5. Line analysis and ridership Specific elements of this plan include: Freuuencv Improvements Improved frequency of service was the number one priority of both riders and the general population in terms of desired service improvements. Therefore, peak hour reductions to 15 minutes, at least in the peak direction, are a top priority in terms of service improvements. Among those lines where peak headway reductions should be made in the Second Stage Plan are Lines 26, 54, 60, 66 and 70. Capacity Improvements Additional peak trippers will be needed on many routes to provide sufficient capacity. It is not yet specifically known where these trippers will be needed, but they will be identified through the continuing line analysis and evaluation process. Although partly due to normal ridership growth, much of the need for additional capacity will come from Transit District efforts to assume additional responsibility for . school student transportation, as School District bus service 'is cut back due to dropping enrollments and Proposition 13. The Transit District and School•Districts are currently .developing a phased plan for coordination of student ;transportation. Express Service Expansion The addition of express routes has been identified as a high priority need by the market survey of County residents. In addition the high growth in jobs in Santa Clara County has created a critical need for additional commute transportation. The County manufacturing community ans also become actively involved in promoting and developing Express Bus service. The County's Express Service is being increased signifi- cantly in 1979. Two new lines started in January, 1979, and two others are scheduled for mid -1979. The Second Stage ex- pansion will continue this phased implementation with service planned on the following lines: -37- Express 7 - Highway 85, Cupertino to Ames /Lockheed Express 8 - San Tomas "Expressway Express 1 - Added peak hour service on 280 Express 3 - Highway 17, Los Gatos - Downtown San Jose -BART The Express Service program will be suplemented by other TSM measures, such as HOV lanes, signal pre - emption, Park -and- Ride lots, etc., which are covered seperately in this report. In addition, major industries are supporting the program with other TSM measures such as staggered hours, parking policies, bus ticket sales, shuttle service and the like. Establishment of New Routes Two new lines are planned for this phase of the expansion. They are: Line 74 - Morrill and Capitol Avenue; Eastridge to Milpitas Line 38 - Branham Avenue; Monterey Highway to West Valley College Selection of these two lines is based partly on customer requests and partly on the analysis of current ridership which shows that other routes in the same areas as Lines 74 and 38 have attracted significant ridership. In addition these two lines will help to serve school transportation needs. (ASSIST), a California corporation. The parties agree: 1. During the period commencing when this contract is signed by the Town and continuing through June 30, 1981 ASSIST will operate a bus system to carry elderly and physically handicapped persons. 2. At first, the system will use one bus. The Town may elect to add another bus. (To simplify the language of this contract, the word "bus" means "buses" if there are two). The Town and the City of Saratoga will own the bus. 3. ASSIST will hire and supervise, as its employees, on an hourly basis, a driver for each bus and one program coordinator. 4. ASSIST will provide all employee benefits required by law, including Workers' Compensation Insurance, Unemployment Disability Insurance and Old Age and Survivors Benefits and ordinary medical insurance. 5. ASSIST knows the work to be done under the terms of this contract is paid for with money from a Transportation Development Act grant, and will comply with all State and Federal requirements about nondiscrimination in hiring and retention of employees. 6. ASSIST will operate the bus on an 8:00 am to 5:00 pm basis, Mondays through Fridays, except on the following holidays: January 1 Third Monday in February Last Monday in May July 4 First Monday in September Thanksgiving Day Friday following Thanksgiving Half -day on December 24 December 25 Half -day on December 31 7. ASSIST will operate the bus in the areas shown on the map which is attached to this contract marked Exhibit A. There are three regions for service: (1) the areas within the city limits (not including unincorporated islands) of Saratoga, Monte Serene or the Town, (2) the area outside, but within two tenths of a mile of area (1), and (3) the area outside areas (1) and (2) but within 10 miles of area (1). (Mileages are miles actually traveled.) ASSIST will carry passengers who initiate their trips anywhere in area (1) to any point in areas (1) and (2), and for medical, dental, and physical therapy appointments only, to any point in area (3). ASSIST will not carry passengers on trips that begin in areas (2) and (3) unless.the trip is a return trip to area (1). 8. ASSIST will carry only passengers who are senior citizens or who are physically handicapped and in either case who reside in area (1). Senior citizens are persons who are 60 years old or older. A functional definition of a handicapped person, as stated in BAY REGION TRANSIT OPERATORS' DISCOUNT FARE PROCEDURE FOR HANDICAPPED PERSONS (12 /75)is as follows: A mass transportation handicap is any incapacity or disability which results in the inability of a person to perform one or more of the following functions. 1) Negotiating a flight of stairs, escalor or ramp. 2) Standing while waiting for a public transit vehicle. 3) Boarding or alighting from a public transit vehicle. 4) Standing in a moving public transit vehicle. 5) Reading informational signs. 6) Hearing announcements by train conductors, bus drivers or station agents. 7) Walking more than 200 feet. The Eligibility Criteria (definition of handicap) were developed based on a person's ability or inability to use mass transportation services and presume a level of personal mobility and independence to the degree that use of public transportation systems would be a reasonable expectation. -2- 9. ASSIST will not charge its passengers cash for rides and will provide service only in exchange for tickets; one ticket for each one way trip within areas (1) and (2) and two tickets for each one way trip that begins or ends in area (3). 10. The clerks of the Town and of the City of Saratoga will sell the tickets in their offices at a price of 50 cents each. When passengers are unable to personally purchase tickets at either of the clerks' offices, ASSIST's drivers, on being instructed to do so by the program coordinator may take tickets to the passengers, and sell them. The driver and ASSIST will be jointly and severally responsible, no later than the next business day, for paying the clerk for the ticket and for establishing to the satisfaction of the clerk that the purchaser was a senior citizen or way physically handicapped. 11. ASSIST will schedule regular bus runs, and may, for example (but not by way of limitation) set times and days for runs to specified hospitals in area (3). 12. Subject to scheduling requirements and subject to the operational limitations of a small bus, ASSIST will provide door -to -door service in response both to telephone requests and to requests communicated in any manner. 13. As needed, the ASSIST driver will escort passengers to and from the outside entrances of the buildings at the origins and destinations of their trips. 14. ASSIST will enforce whatever measures are necessary to provide service that is rendered in a courteous and kindly manner, as well as efficiently and safely. 15. ASSIST will pay its driver for operating time and normal rest breaks. 16. The Town will provide or procure for ASSIST the services described in paragraphs 5, 7, 10, 11, 12, 13 and 14 of the contract between Los Gatos and Saratoga entitled Contract for Transportation Program for Elderly and Handicapped Persons dated ©g Q -AZ Myr). 17. ASSIST will provide an officer, employee or contractor of its own to hire, evaluate, direct, discipline and fire its driver and program coordinator. ASSIST will pay that person at the rate, and not more than the total amount, shown for supervision -3- in the budget attached to this contract marked Exhibit B. Reimburse- ment for ASSIST's expense for providing services required by this paragraph will be for direct hourly pay only, although ASSIST will comply with all requirements of law concerning its relationship with that person, including providing Workers' Compensation and other necessary benefits if that person is an employee. 18. ASSIST will provide expendable office supplies such as stationery, postage, separate telephone service, paging (beeper) service and advertising. ASSIST will also provide the driver or program coordinator mileage reimbursement of 22� per mile when incurred by transporting clients or other work related assignments. 19. The Town will reimburse ASSIST for its expense of rendering the services and providing supplies required by this contract except for the rule of reimbursement of paragraph 18 expenses on a dollar for dollar basis. ASSIST will keep its expenses within the line item limits set in the Exhibit B budget. 20. On a calendar month basis, on or before the Wednesday Preceding the first Monday of each month, ASSIST will account to the Town for all of its expenditures during the preceding month. By the tenth of the following month the Town will make the reim- bursement payment, except when it reasonably appears, as determined by the Director and agreed to by ASSIST, that ASSIST has sufficient money on hand to continue or conclude operations without payment for that month. 21. ASSIST will keep good and detailed records of its operations, financial transactions and payroll, and will evidence all payments with appropriate invoices and vouchers. The manner in which ASSIST keeps records and handles petty cash (if any) will be specified by the Director. ASSIST will give the Town acdess to all of its records. 22. ASSIST's records will include (1) trip logs kept by the driver showing the addresses of all origins and destinations, times and odometer readings, including stops within a trip to pick up or let off any passenger, and (2) dispatching logs showing all calls for service with the surname and address of each caller and the time of the call, and all dispatching orders with the address to which the dispatch is made and the time of the order. -4- 23. ASSIST will maintain all of its records for a minimum of three years after performance of this contract is complete, open and available for inspection and audit by the Town and any govern- mental agency, and will provide copies of all or any of its records to the Town on request. This contract is made with reference to the following facts. The cities of Saratoga and Monte Sereno and the Town of Los Gatos are all adjoining general law cities. The Metropolitan Transportation Commission (MTC) is an agency of the State of California created under the provisions of the Metropolitan Transportation Commission Act (Gov.Cg66500, et seq., Stats. 1970, c.891). MTC provides Transportation Development Act (Stats. 1971, e.1400, Pub. Utilities C. § §99240(d), 99260) (TDA) money to cities to operate transit systems. Saratoga and Los Gatos (for convenience, these two cities only are called "the cities ") have jointly applied for and will receive an allocation of TDA money. Monte Serene has voluntarily "waived" (as the term is used by MTC) its allocation of TDA money so that money can be used by the cities. The cities intend to use their allocations and Monte Serene's to pay for the operation of a small bus system for elderly and handicapped persons. A Private, nonprofit corporation will operate and dispatch the bus or buses under contract with Los Gatos. This contract requires Los Gatos to enter into that contract, lists the support services that Saratoga and Los Gatos will give the operator, and provides for reimbursement to Saratoga and Los Gatos for their expenses. The cities agree: 1• Los Gatos will immediately enter into a contract with West Valley Action Service for Study of Special Tasks, Inc., a California corporation (ASSIST). A copy of that contract is attached to this one, marked Exhibit A. 2. Saratoga will turn over to Los Gatos Sara-toga's share Of 1980 -81 TDA money. Los Gatos will account for the TDA money separately from other funds. 3. When this contract calls for payments, including reim- bursements, the money used will be, and will be limited to, the TDA money contributed by the cities and Monte Sereno. 4. Los Gatos will perform all of its obligations under its contract with ASSIST to the extent provided by this contract. Los Gatos will be reimbursed for its expenses of performing the ASSIST contract. 5. Los Gatos will provide or procure liability insurance for all operations of the transit system, insuring the cities and ASSIST against liability for the acts and omissions of ASSIST related in any way to the operation of the transit system. The insurance contract will include a cross - liability endorsement and will provide that the carrier will have no right of indemnity or contribution from the cities or ASSIST. As used in this paragraph, the words the cities and ASSIST include their officers, agents and employees. 6. Saratoga will provide staff time sufficient to monitor program performance to determine whether there is compliance with MTC -TDA grant regulations, and will prepare and file the quarterly narrative reports required of Article 4.5 claimants and the quarterly financial and operations reports. 7. On request from ASSIST, Saratoga will provide storage space at its corporation yard for the bus or buses. 8. Saratoga will be reimbursed from the TDA money for the expense of performing the administrative functions described in paragraph 6, but not for providing storage space described in paragraph 7. 9. Staff members from both of the cities will participate as representatives on the Santa Clara County Paratransit Coordi- nating Council. Neither city will be reimbursed for the time spent on that activity. 10. The clerks of both of the cities will sell the bus tickets at their offices. They will, in concert with the Town Director Of Community Programs and the Saratoga Housing and Community Development Director set rules for purchasers to show that they are senior citizens or physically handicapped, and will sell tickets to no others. The clerks will account for the tickets and the money from ticket sales, and no less often than monthly will deposit the money in the Town's TDA account. -2- 11. Los Gatos will, either directly or using its own contractors, provide repairs, routine maintenance, tires, parts, road service (including towing) and lubricants for the bus or buses used in the program. 12. Los Gatos may provide gasoline from its own supplies, but will do so only to the extent that Los Gatos' Director of Public Works determines is proper. 13. Los Gatos will provide ASSIST office space in the Down- town Neighborhood Center for one dispatcher and the necessary office furniture and equipment. 14. On request from ASSIST, Los Gatos will provide storage space at its corporation yard for the bus or buses. 15. Los Gatos will be reimbursed from the TDA money for its premium cost in providing the insurance described in paragraph 5, for its expense incurred in performing the services and providing the supplies described in paragraphs 10 and 11, and, if it elects to request reimbursement, for providing the office space in the Downtown Neighborhood Community Center described in paragraph 13, but not for the storage space described in paragraph 14. Reim- bursement for tires, parts, contracted service, gasoline and lubricants will be at cost. Reimbursement for providing the office space will equal the reasonable rental value of the space. 16. Reimbursement for services rendered to ASSIST by Los Gatos or for staff services by either city which are under the terms of this contract reimbursable, will equal the cost of direct labor, including fringe benefits and insurance as well as payroll but not including general or administrative expense or supervision. 17. Any property that is purchased in the performance of this contract or the contract between Los Gatos and ASSIST is owned in common by the cities. Their ownership interests are in the same Proportions as amounts of their TDA money pooled for the performance of this contract for the 1979 -80 fiscal period. 18. On termination of the small bus program state and federal rules then in effect govern disposition of any remaining money and other property acquired. If no other federal or state rule applies, the cities may then agree to sell the property or may agree that -3- one city will acquire the interest of the other. If they do not agree on how to dispose of the property, they will advertise it for public sale by sealed bid in separate lots with a minimum price on each lot. The bid, if any, of one of the cities shall be expressed two ways -- as a total price for the lot and as an actual price, which is the total price reduced by an amount propor- tional to the bidding city's ownership interest. The former deter - mines success in the bidding; the latter is the price to be paid if the city bids successfully. 19. This contract is effective from the time it is signed by the last of the two cities, through the time for performance of the Exhibit A contract and until all property is disposed of, all reimbursements are made and all audits are completed. CLAIMANT'S CERTIFICATION The (claimant) establishes its eligibility for an allocation of Transportation Development Act (TDA) funds under Section (7) of the Public Utilities Code. Claimant's ratio of fares to total operating cost in FY 1978 -79 was (8) percent. It is inappropriate to apply the FY 1978 -79 as the base year to the Transit ASSIST program. The Transit ASSIST program did not exist in that funding year. Tkiat did exist was a subsidized taxi program that operated only within the Town of Los Gatos City boundaries. The Transit ASSIST program is a cooperative van program between three cities, therefore, the van provides services within the boundaries of the three cities (not only Los Gatos) and also extends madical purpose service trips 10 miles outside the three city's boundaries. CONFORMANCE OF CLAIM WITH APPLICABLE STATUTES RULES AND POLICIES The staff has reviewed this claim for conformance with the statutes and rules of the Transportation Development Act and the regulations of the Metropolitan Transportation Commission. As discussed below, the claim appears to be in conflict with Commission policy as articulated in MTC Resolution No. 467. IV. ANALYSIS OF ISSUES AND PROPOSED MTC RESPONSE A combined Article 4.5 claim by the municipalities of Los Gatos, Saratoga and Monte Sereno for 1980 -81 originally contemplated capital costs of $13,000 to purchase a 15- passenger accessible van. (Under the county -wide coordinated claim, however, this money was allocated as operating costs.) The claimants have requested a revision to this claim to purchase a station wagon instead of the van. Reasons for the claim change given by the claimants are: -2- o the capital cost would be cheaper (approximately $7,500 purchase cost); o operating costs would be cheaper; the station wagon would be easier to use for elderly passengers than the current van, and some passengers feel that a station wagon would be a less obvious vehicle. The claimant sent out RFPs for both a station wagon and a non - accessible van, and received bids only from station wagon dealers. The claimant has not yet requested bids for an accessible vehicle. On January 22, 1981, the Executive Committee of the PCC endorsed the request for the station wagon by a vote of five affirmative, three negative, and one abstention, after extensive discussion. MTC staff does not recommend approval of this claim for these reasons: (1) If a station wagon is purchased, the program will have two vehicles that would not be easily accessible to handicapped passengers. The program's existing vehicle, purchased a year ago, has no raised roof, and entrance to the vehicle by way of a rear door is awkward for a wheelchair user. The design of the current van does not permit non - wheelchair users to take advantage of the lift, and indeed presents difficulties in entering and exiting for almost all the program's passengers. MTC staff acknowledges that a second vehicle is necessary to meet the increasing demand for the service, but it appears likely that a new van can best overcome the deficiencies of the present vehicle. (2) MTC policy under Resolution No. 467 is "to only approve proposed grants involving the purchase of smaller than standard size buses for public mass transportation operations (including conventional fixed route system, specialized, or supplemental services) that are wheelchair accessible..." Although operating funds have been provided under TDA 4.5 to some inaccessible subsidized taxi programs, most of these are coordinated with accessible van programs. Making an exception to allow purchase of a station wagon, which is not accessible to all wheelchair users, undermines MTC's long- standing policy of full accessiblity. -3- (3) MTC's present planning work in developing the action plans in response to AB120 will include plans to best utilize and coordinate existing paratransit and social service agency transportation programs. Under these action plans it is anticipated that recommendations regarding more effective use of lift - equipped vehicles will be developed to serve as many mobility- impaired passengers as possible, and may well include coordination of Article 4.5 programs with other providers. Under these circumstances, it is important to maintain high levels of vehicle accessibility and seating capacity, and an accessible van would serve these needs better than a station wagon. Summary Considering MTC's existing policy on equal accessibility and current planning efforts, it does not seem appropriate that a non- accessible vehicle be purchased with TDA funds, particularly in light of the problems experienced with the current vehicle. MTC staff will be available to assist the sub - committee of the Santa Clara PCC that will be working to develop more detailed and practical specifications for an accessible van. Adequate funds are available for purchase of a second van, to better serve a greater number of the program's passengers. V. STAFF RECOMMENDATIONS MTC staff does not recommend approval of the requested claim revision. MTC staff recommends that the Grant Review and Allocations Committee direct the staff to work with the claimants to develop a satisfactory solution, for purchase of a second vehicle, that is consistent with MTC Resolution No. 467.
