1980-176-Approving Contract For Mediation Services And Authorizing Town Manager To Execute Such Contracts With Qualified MediatorsRESOLUTION NO. 1980 -176 RESOLU'T'ION APPROVING CONTRACT FOR MEDIATION SERVICES AND AUTHORIZING TOWN MANAGER TO EXECUTE SUCH CONTRACTS WITH QUALIFIED MEDIATORS BESOLVED, by the Town Council of the Town of Los Gatos, that the attached Contract for Mediation Services is hereby approved, and i;he Town Manager is autnorizep to execute such contracts with qualified mediators as called for in Section 24:20.055 of Ordinance No. 14'77. ATTEST: CLERK OF 'HE 10 i OF LOS 0909 CONTRACT FOR MEDIATION SERVICES THIS AGREEMENT, entered into this day of 1980, between the Town of Los Gatos, hereinafter referred to as "Town ", and hereinafter referred to as "Mediator ", W I T N E S S E T H: RECITALS: 1. The Town has adopted Ordinance No. 1477, establishing a rental dispute mediation and arbitration process, which calls for the use of trained personnel to conduct such process. 2. Mediator represents him /herself to be trained and qualified to perform mediation or arbitration services under the Ordinance. ACRFFMFNT• In consideration of the foregoing recitals and their respective promises hereunder, the parties agree as follows: A. Duties of Mediator Mediator agrees to do the following: 1. Provide the Town or its agent with an accurate address and phone number(s) where Mediator can be reached at any time within one (1) day 2. Be available at all times for assignment to mediation or arbitration upon forty -eight (48) hours' notice, unless valid reasons for unavailability have been provided in advance in writing. 3. To conduct all hearings conscientiously and in accordance with the rules and code of ethics of the American Arbitration Association. 4. File complete and timely written reports after each hearing as required by the Town. -1- 5. Attend all meetings of the Mediation Board, unless excused in advance for good cause. 6. Follow the standards and guidelines set forth in Ordinance No. 1477, and any amendments thereto. B. Compensation. In exchange for the foregoing services, the Town shall pay Mediator sixty -five ($65.00) dollars for each mediation conducted and one hundred twenty -five ($125.00) dollars for each arbitration conducted. Town does not guarantee any frequency of assignment. It is understood that the foregoing fees apply regardless of the length of the hearing, and that Mediator is obligated under Paragraph A hereof to devote whatever time to each hearing is necessary to adequately resolve the issues presented. C. Term. The term of this agreement shall be one (1) year from the date written above, unless terminated sooner. Either party may terminate this Agreement without cause by giving the other party thirty (30) days written notice to the following addresses: TOWN: MEDIATOR: -2- IN WITNESS WHEREOF the parties have hereunto set their hands effective the date first written above.
