1980-166-Approving Agreement With Hughes, Heiss & Associates Providing For Analysis Of Town Attorney PositionRESOLUTION NO. 1980 -166 A RESOLUTION APPROVING AGREEMENT WITH HUGHES, HEISS & ASSOCIATES PROVIDING FOR ANALYSIS OF TOWN ATTORNEY POSITION. BE IT RESOLVED, and it is hereby resolved by the Town Council of the Town of Los Gatos, County of Santa Clara, State of California, that the Town of Los Gatos enter into an agreement with Hughes, Heiss & Associates of San Mateo, California (a copy of which is attached hereto); and BE IT FURTHER RESOLVED that the Mayor is authorized and is hereby directed to execute said agreement in the name and in behalf of the Town of Los Gatos. Ferrito NOES: COUNCIL MEMBERS None ABSENT: COUNCIL MEMBERS Ruth Cannon ABSTAIN: COUNCIL MEMBERS None SIGNED: �%�_�., 1Ih1�A OR° OF THE TOWN,X � _O GATOS ATTEST: CLERK OF THE TOWN OF LOS, TOS AGREEMENT This Agreement, made as of the 26th day of September 1980, is by and between the Town of Los Gatos (hereinafter called the "Town ") and located at 110 East Main Street, Los Gatos, California, and Hughes, Heiss & Associates (hereinafter called the "consultant "), located at 181 Second Avenue (P. 0. Box 1879),San Mateo, California 94401. 1. RECITALS The Town desires to undertake an analysis of the Town Attorney position to determine the merits of full -time versus part -time legal assistance. The consultant is qualified to conduct this analysis and agrees to assist the Town Council by performing this service. 2. SCOPE OF WORK The consultant shall perform the following tasks in analyzing the Town Attorney position: (1) Identify the workload of the Town Attorney's Office for the past two years, based on available information. Included would be document complaints filed, ordinances and resolutions considered and prepared, litigation activities, meetings attended, etc. , (2) Determine the potential "proactive" workload and time requirements now and in the future created by Town action on community problems such as controlling cruising and downtown zoning actions, (3) Measure service levels desired by the Council and Town staff in legal services area, (4) Comment on the quality of legal aid available either part time or full time in relation to the Town's perceived needs, (5) Analyze other communities of comparable demographics including those using part time and full time city attorneys to determine workloads, city support levels, and levels of responsiveness. The above scope of work is intended to be a summary of the work tasks outlined in the proposal submitted by consultant dated August 26, 1980. 3. CONSULTANT FEE The Town shall pay the consultant a fixed fee of $3,000including expenses, for the analytical services performed. Payment shall be made to the consultant upon completion of the work to be performed. 4. RECRUITMENT TEAM The consultant shall assign Richard A. Hughes and Richard W. Perry as its analytical team. 5. TIMING The analysis re the Town Attorney position shall be completed by the consultant by November 1, 1980 or before.
