A RESOLUTION ESTABLISHING THE TOWN
MEDIATION BOARD
RESOLVED BY the Town Council of the Town of Los Gatos, County
of Santa Clara, State of California that the Town Council hereby establishes
the Mediation Board. The Board shall be advisory to the Community Services
and Development Commission and shall operate in the manner hereluaf ter
prescribed.
1. AMIBERSHIP - ORGANIZATION
a. The Mediation Board shall consist of all members of the
mediator pool whose terms of office shall be one (1) year and until their
successors are appointed. The members shall be appointed by the Town Manager.
,Santa CI_ara County Information and Referral, as contract agency, shall
have a representative attending all Mediation Board meetings.
The Town Thnager shall fill any vacancies occuring during the
term of the Board and shall name the pro tem Chairperson and Vice- Chairperson
who would serve for a term of three months. Following that time, the
Board shall elect a Chairperson and Vice - Chairperson.
b. One third of the members of the Board shall constitute a
quorum for the purpose of transacting business. Any member shall have
the right to present a minority view to the Commission in reference to
any report or recommendation the Board may make.
c. The members shall serve on this Board without compensation,.
d. The Board shall establish a regular time for its meetings
and regular meetings shall be held in the Los Gatos Downtown Neighborhood
Center and snail otherwise call and conduct its meetings in compliance
with the provisions of Section 54950 and 54960 of the Government Code.

e. The Board shall appoint one of its members to prepare and
maintain permanent minutes of the actions taken during its meetings and
shall file copies of its minutes with the Community Programs Department
and the Town Clerk.
f. Three consecutive absences from regularly scheduled meetings
of the Board shall be construed as resignation of membership unless the
member involved formally requests to retain membership and a majority
vote of the Board sustaines the request.
2. DUTIES AND FUNCTIONS.
a. The duties and functions of the Board shall be to insure the
implementation of the T'own's Rental Dispute Mediation /Arbitration Ordinance.
Specific activities would include but are not limited to:
1) Advising the Town on the proper role it should assume for
the implementing the guidelines contained in the Rental Dispute Mediation/
Arbitration Ordinance,

2) Assisting the Town in coordinating its own mediator /arbitrator
3) Advising the Town on emerging community needs.
V The Board shah periodically review the Rental Dispute
Mediation/Arbitration Ordinance and recommend changes needed to meet new
conditions and to respond to the changing community environment.
c. The Board shall identify the training needs of the mediator/
arbitrator pool.
d. In developing recommendations for the Town, the Board Should:
1) Elicit input and support of various relevent community
individuals and groups.

2) Study and examine submitted reports.
3) Evaluate the effectiveness or the existing program and
make constructive suggestions for its improvement to the Community Services
and Deve_opment Commission.
3. DURATION OF THE BOARD:
This Board shall be in effect from November 5, 1980, and shall
terminate upon the expiration of Ordinance 1477.
PASSED AND ADOPTED AT A REGULAR meeting of the Town Council_ of
the Town of Los Gatos held on the 27th day of OcLober, J_980, by the
following votes:
