A RESOLUTION REVERSING A DECISION OF THE
TOWN PLANNING COMMISSION
WHEREAS, James A. Stoops has duly and regularly filed an appeal
with the Town Council, from a decision of the Town .Planning Commission as
follows: denial of tree removal permit on property located at 15 Highland
Avenue.
WHEREAS, a public hearing was held by the Town Council on
September 15, 1950.
WHEREAS, the Town Council has determined that the decision of
the Town Planning Commission should be reversed.
BE IT RESOLVED:
The decision of the Town Planning Commission, is reversed, as the
Planning Commission did not adequately consider the effects of flooding and
erosion on the health of the tree and therefore the Bay tree may be removed.
PASSED AND ADOPTED AT A REGULAR MEETING OF THE TOWN COUNCIL OF THE
TOWN OF LOS GATOS this 15th day of September, 1950, by the following votes:
AYES: COUNCIL MEMBERS; Ruth Cannon, MarLyn J. Rasmussen and
Peter W. Siemens
NOES: COUNCIL MEMBERS: Brent N. Ventura and Thomas J. Ferrite
