RESOLUTION OF THE LOS GATOS TOWN COUNCIL TO
ACCEPT A PROPOSAL FOR ASSISTED HOUSING AS
PRESENTED BY SHEEHAN /SCHAFFRAN
RESOLVED by the Council of the TOWN OF LOS GATOS:
1. In accordance with policies and standards adopted by the Council and the
regulations of the United States Department of Housing and Urban Development,
the Council accepts the proposal by Jack W. Sheehan, Inc. and E. M. Schaffran
& Co., for the construction of an assisted housing project to be built on
land owned by the Town.
2. This acceptance is limited at this time to permission for Jack W. Sheehan, Jr.
and E. M. Schaffran & Co. to:
a) File the necessary papers and documents with the United States
Department of Housing and Urban Development for preliminary approval
under the Housing Assistance Payments Program for New Construction.
The request for preliminary proposal must be submitted to the United
States Department of Housing and Urban Development office in San
Francisco by August 25, 1980;
b) File the necessary forms and documents with the Town Planning Department
to commence the zoning approval process.
3. This acceptance will be withdrawn by the Council if any of the following occurs:
a) The Town submits the proposal to the voters for approval and the measure
fails.
b) The Town does not successfully complete the purchase of the land from the
County of Santa Clara.
c) Any zoning approvals required for the project are successfully challenged
as the result of a law suit or a referendum.
d) The project is rejected by the Department of Housing and Urban Development
or modified by the Department of Housing and Urban Development to a degree
that is unacceptable to the Town.
e) It is determined that it would be unlawful for the Town to carry out any
part of the project.

f) The Town's preference system for occupancy of the project is not
approved by the Department of Housing and Urban Development.
g) The developer makes any significant deviation at any time from the
original proposal.
4. Acceptance of this proposal does not obligate the Town for any costs
incurred by the developer during the processing of the Housing and Urban
Development and Town applications.
5. Further, the Town requires that copies of all documents submitted to the
United States Department of Housing and Urban Development be submitted
simultaneously to the Town.
The Town Manager is hereby authorized to act in behalf of the Town
for any matters regarding the United States Department of Housing and Urban
Development processing specified in this resolution.

Town of Los Gatos held on the 7th day of August , 1980, by the
following vote:
