A RESOLUTION REVERSING A DECISION OF THE
TOWN PLANNING COMMISSION
WHEREAS, Hufjon Corporation. dba Tropic Tan, has duly and regularly
riled an appeal with the Town Council, from a decision of the Town Planning
Commission as follows: Denial of Conditional Use Permit U -80 -13 requesting
approval to operate a tanning studio at 20 South Santa Cruz Avenue, 11301.
WHEREAS, a public hearing was held by the Town Council on July 7,1980.
WHEREAS, The Town Council has determined that the decision of the
Town Planning Commission should be reversed.
BE IT RESOLVED:
The decision of the Town. Planning Commission, is reversed, in that
the Council finds that the Planning Commission used personal judgement rather
than technical application of the ordinance governing the use permit.
FURTHER RESOLVED: The approval of the application is subject to
the following conditions:
1. The studio shall not operate between the hours
of 9 p.m. and 9 a.m.
2. Modified sprinkler plans shall. be submitted to
the Central Fire Protection District for approval.
Each tanning but shall_ be sprinklered.
3. The applicant shall provide a ZAJOBC fire extinguisher.
4. No minor allowed without parental approval.
5. The studio shall be made accessible to the handi-
capped as required by the Chief Building Official.
6. All equipment is to be operated and maintained in
accordance with Federal_ and State standards and
regulations.
7. The applicant shall supply to the Town, annually
with the business license renewal, a copy of the
current standards and regulations and a letter
detailing how this tanning studio is in compliance
with them.
PASSED AND ADOPTED AT A REGULAR FETING OF THE TOWN COUNCIL OF TIE
TOWN OF LOS GATOS this 7th day of July, 7.950, by the following votes:
