A RESOLUTION REVERSING A DECISION OF THE
'TOWN PLANNING COMMISSION
WHEREAS, Barbara Spector has duly and regularly filed an appeal with
the Town Council, from a decision of the Town Planning Commission as follows:
approval to enclose an existing outdoor patio for the Antique Restaurant at
50 University Avenue.
WHEREAS, a public hearisig was held by the Town Council on June ].6,].980.
WHEREAS, the Town Council has determined that the decision of the Town
Planning Commission should be reversed.
BE IT RESOLVED:
The decision of the Town Planning Commission, is reversed, as the
Planning Commission erred in not finding that the expansion of this use is not
essential or desirable to the public welfare because any increase of activities
at this location would cause an unexceptable further impact on traffic, parking
and law enforcement problems; and the benefits of proposal do not warrant the
risk that would be involved to the oak tree.
PASSED AND ADOPTED AT A REGULAR MEETING OF THE TOWN COUNCIL OF THE
TOWN OF LOS GATOS this 16th day of June,1980 by the following votes:
