A RESOLU'T'ION REVERSING A DECISION OF THE
TOWN PLANNING COMMISSION
WHEREAS, Tanning Studio - Icarian Enterprises, Inc., has duly and
regularly filed an appeal with the Town Council, from a decision of the Town
Planning Commission as follows: Denia:L of a Conditiona.t Use Permit Application
U -60 -i2 requesting approval to operate a tanning studio at 477 -B North Santa
Cruz Avenue.
WHEREAS, a public hearing was held by the Town Council on June 2,1980.
WHEREAS, the Town Council has determined that the decision o1' the Town
Planning Commission should be reversed.
BE IT RESOLVED:
The decision of the Town Planning Commission, is reversed, in that the
Council finds that the Planning Commission used personal judgement rather Lhan
technical application of the ordinance governing the use permit.
FURTHER RESOLVED: The approval of the application is subject to the
following conditions:
1. The studio shall not operate at any time between
the hours of 7:00 p.m. and 9:00 a.m.
2. A revised site plan for the improvement of the
parking lot including surface improvements or
restriping, shall be submitted to the satisfaction
of the Planning Director and Town Engineer. No
occupancy of the studio shall be permitted until
the parking lot work is completed.
3. The studio shall be made accessible to the handi-
capped as required by the Chief Building Official.
4. All employees will. be required to park in the Town's
long term employee parking lot on the east side of
North Santa Cruz Avenue.
5. All equipment is to be operated and maintained in
accordance with Federal and State standards and
regulations.
6. The applicant sha.1.1 supply to the Town, annually
with the business license renewal, a copy of the
current standards and regulations and a letter
detailing how this 'tanning studio is in compliance
with them.
PASSED AND ADOPTED AT A REGULAR MEETING OF THE TOWN COUNCIL OF THE TOWN
OF LOS GATOS this 2nd day of June, 1980, by the following votes:
