1980-042-Approving A Contract For Softball Field ImprovementsRESOLUTION NO. 1980 -42 RESOLUTION APPROVING A CONTRACT FOR SOFTBALL FIELD IMPROVEMENTS RESOLVED, the Town Council of the Town of Los Gatos, that the TOWN enter into the agreement entitled "Softball Diamond Construction Agreement" with the Los Gatos - Saratoga Community Education - Recreation Advisory Committee, a copy of which is attached hereto, and that the Mayor is directed to execute the agreement on behalf of the TOWN. Siemem-, and John H Lo::hrier NOES: COUNCILMEMBERS None ABSTAIN: COUNCILiMEMBERS_None ABSENT: COUNCILMEMBERS None SIGN ATTEST: Clerk, Town of Los Ga ITEM V H 4 -4 -801 SOFTBALL DIAMOND CONSTRUCTION AGREEMENT The Los Gatos - Saratoga Community Education - Recreation Advisory Committee was formed by agreement dated the 15th day of June 1979 among the Los Gatos Joint Union High School District, the Los Gatos Union Elementary School District, and the Saratoga Union Elementary School District. The Advisory Committee's nature and powers, including the power to contract concerning community education and recreation services on behalf of the districts,are set out in the agreement. The Town of Los Gatos is a general law city. The Advisory Committee and the Town want a softball diamond for school and public use to be constructed on the high school property on Main Street in Los Gatos. The parties agree: 1. Within 45 days of the execution of this agreement by the Advisory Committee the Town will pay the Committee $20,000, cash. 2. Promptly on receiving the money, the Advisory Committee and the Los Gatos Joint Union High School District will take whatever steps are necessary to construct and to provide for the construction of a standard, turf, lighted, softball diamond on the easterly side of the lower athletic field at Los Gatos High School. 3. The cost of construction will be more than $20,000; the Advisory Committee, acting on behalf of the school districts which formed it, will use its own money and the $20,000 received from the Town to pay for the project. 4 -4 -80 PWH /j 4. If the softball diamond is not completed in all respects by June 30, 1481, the Advisory Committee will refund the $20,000 to the Town. S. The softball diamond will be constructed according to the specifications on the sheet marked "Exhibit A attached to this agreement. 6. On behalf of the Los Gatos Joint Union High School District the Advisory Committee agrees that the softball diamond will at all reasonable times except times when use of the softball diamond would interfere with normal high school activities, be kept open for use by the general public. "Use by the general public" includes use under a reasonable reservation system and use for scheduled league play, both of which will be admininstered by the Director of Community Education - Recreation. 7.
