RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING THE APPEAL OF THE CENTRAL FIRE DIS I'RICT DECISION
TO NOT ALLOW A PROPANE GAS TANK TO BE LOCATED WITHIN FEN
FEET OF THE PROPERTY LINE
(15308 TOP OF THE HILL ROAD - PROPERTY OWNER
MR. AND MRS. THOMAS L. DASHIELL)
WHEREAS:
A. Mr. and Mrs. Thomas L. Dashiell have appealed a decision of the Central
Fire District to have a propane gas tank located at 15308 Top of Hill Road be located in
accordance with the Uniform Fire Code.
B. A public hearing was held and concluded on January 7, 1991.
C. At the public bearing, a representative of the Central Fire District stated that
the District will grant the applicant a permit providing they construct a safety wall, which
is an "alternate materials method" of complying with the Fire Code.
RESOLVED:
A. The Town Council hereby finds that no evidence or testimony was presented
that the decision of the Central Fire District was in error.
B. The Town Council finds that in the interest of public safety the propane tank
at the subject address should be located as per the requirements of the Uniform Fire Code.
C. Based on the foregoing findings the Town Council denies the appeal and
remands the enforcement of Uniform Fire Code criteria for safe propane gas tank
installation to the Central Fire District.
Pursuant to Los Gatos Town Code Section 1-15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.

of Los Gatos, California, held on the 4th day of February, 1991 by the following vote.
