RESOLUTION OF THE TOWN OF LOS GATOS
OPPOSING SB 2557 AND OPPOSING
THE SANTA CLARA COUNTY BOARD OF SUPERVISORS'
DECISION TO IMPOSE FEES ON BOOKING PRISONERS
WHEREAS, the cost of booking prisoners is already paid by Town residents
through their property tax to the County General Fund, and its support of the Sheriff's
Department. Town residents receive no detective, patrol, or other such services from the
Sheriff, even though they pay the same tax rates; and
WHEREAS, County residents receive services free for which Town residents are
forced to pay extra; and
WHEREAS, SB 2557 punishes agencies which provide good service and make
many arrests while it rewards agencies which fail to provide good service and encourages
them not to make needed arrests; and
WHEREAS, SB 2557 allows State legislators to avoid responsibility for
mandating programs without providing the necessary funding for those programs; and
WHEREAS, SB 2557 provided counties with fiscal options other than booking
fees but the County has not pursued those other options; and
WHEREAS, other counties have pursued options other than booking fees; and
WHEREAS, the Santa Clara County Board of Supervisors voted to charge the
Town of Los Gatos for booking prisoners retroactively to July 1, 1990, thereby disrupting
needed and previously budgeted services.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town
of Los Gatos strongly urges:
1. The Santa Clara County Board of Supervisors to reverse its decision
to retroactively charge the Town of Los Gatos for booking prisoners.
2. Our State legislative delegation to work vigorously to repeal SB
2557 as a crippling attack on efficient local government and as bad
public policy.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 7th day of January, 1991 by the following vote:
