RESOLUTION AUTHORIZING TOWN ATTORNEY AND THE ABAG
PLAN CORPORATION TO SETTLE TORT CLAIMS NOT EXCEEDING
THE SUM OF $3,000 AND REPEAL RESOLUTION NO. 1987-180
WHEREAS, the Town of Los Gatos is a member of the Association of Bay Area
Governments (ABAG) liability pool known as ABAG Plan Corporation;
WHEREAS, ABAG Plan Corporation is the claims administrator for all claims filed
with the Town of Los Gatos;
WHEREAS, the Town Attorney is the Risk Manager for the Town of Los Gatos; and
WHEREAS, the Town Council wishes to delegate settlement authority for tort claims
not exceeding the sum of $3,000 to the Town Attorney and said claims administrator.
NOW, THEREFORE, BE IT RESOLVED, that the Los Gatos Town Council hereby
repeals Resolution No. 1987-180 entitled "Resolution Authorizing Black & Bland and the
ABAG Plan to settle tort claims not exceeding the sum of $1,500".
RESOLVED, that the Town Council of the Town of Los Gatos does hereby delegate
settlement authority for tort claims against the Town of Los Gatos, its officers and
employees not exceeding the sum of $3,000 to the Town Attorney in its capacity as Risk
Manager and the ABAG Plan Corporation as claims administrator.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 19th day of February, 1991 by the following vote.
