RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
GRANTING APPEAL OF THE DIRECTOR OF BUILDING SERVICES
DECISION TO REQUIRE ACCESSIBILITY FEATURE. PROPERTY LOCATED
AT: 270 E. MAIN S 1'REET. OWNER/APPELLANT: CHARLES PERROTTA
WHEREAS:
A. Charles Perrotta, owner/appellant, has appealed the decision of the Director
of Building Services requiring an accessibility feature to the building located 270 East Main
Street; and,
B. A public hearing was held by the Town Council on March 18, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the Director of Building Services erred in
classifying the business at 270 East Main Street as retail.
B. The Town Council hereby finds that a nail salon is not a retail business, but does
fall under the office designation.
C. Based on the foregoing findings, the Town Council hereby grants the appeal
on the grounds that the Town Council has allowed other similar businesses to go on a
second floor without the accessibility feature that would be required of a retail business.
Pursuant to Los Gatos Town Code Section 1-15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.

of Los Gatos, California, held on the 1st day of April, 1991 by the following vote.
