1979-057-Approving And Authorizing Execution Of A Joint Powers Agreement For Criminal Justice Planning And AdministrationRESOLUTION NO. 1979 -57 RESOLUTION OF THE TOWN OF LOS GATOS APPROVING AND AUTHORIZING EXECUTION OF A JOINT POWERS AGREEMENT FOR CRIMINAL JUSTICE PLANNING AND ADMINISTRATION WHEREAS, the Town Council of the Town of Los Gatos has reviewed the Joint Powers Agreement for Criminal Justice Planning and Administration; and WHEREAS, the Town of Los Gatos desires to obtain grants of money in the Law Enforcement Assistance Administration Program (LEAA); and WHEREAS, the Office of Criminal Justice Planning requests that the application for LEAA grants be made only after projects have been jointly selected by the cities with administrative support services proviced gy the County of Santa Clara. NOW, THEREFORE, BE IT RESOLVED by the Town of Los Gatos that the Joint Powers Agreement for Criminal Justice Planning and Administration, with participation from twelve (12) cities of Santa Clara County named therein be approved and the Mayor of Los Gatos be authorized to execute same on behalf of the Town. Lochner NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: Peter W. ,Siemens SIGNED: ATTEST- CLERK OF THE TOWN OF LOS G$flOS facts: JOINT POWERS AGREEMENT FOR CRIMINIAL JUSTICE PLANNING AND ADMINISTRATION This agreement is made with reference to the following The cities of Campbell, Gilroy, Los Altos, Town of Los Altos Hills, Town of Los Gatos, Milpitas, Monte Sereno, Morgan Hill, Mountain View, Palo Alto, Santa Clara and Sunnyvale (for brevity, called "the cities ") want to obtain grants of money in the Law Enforcement Assistance Administration Program (LEAA). The parties to this agreement, including the County of Santa Clara, expect that the State of California Office of Criminal Justice Planning will designate a specific sum of LEAA money for the cities' use. The Office of Criminal Justice Planning requests that the cities' applications for LEAA grants be made only after projects have been jointly selected by the cities, and that administrative support services for the LEAA program be provided by the County of Santa Clara. The County is willing to provide the administrative and support planning services. The cities make the following agreement: 1. The cities hereby form a Municipal Coordinating Committee. The Committee is composed of one member representing each city, selected in a manner to be determined by each. -1- 3 -2 -79 PWH /j 701 -03 701 -05 -001 2. Although this agreement is made under the provisions of Government Code sections 6500 -6514, the committee is not a separate entity or agency, it is a planning body. During the term of this agreement all of the cities will in all respects comply with the decisions of the committee concerning what applications to file or to refrain from filing under the LEAA program and which city or cities will be applicants, except that any city may decline to apply for a grant. The cities waive their right to appeal decisions of the committee. 3. Each committee member has one vote. The committee acts only by a vote of a majority of its members. Tie votes are not affirmative votes. In all other respects the committee itself determines how it proceeds. The committee must, however, establish its procedures in writing. 4. LEAA grant applications will be made by individual cities (or by more than one city, voluntarily joining for the purpose, if that is appropriate). Each successful applicant will administer the grants made to it, and its principal financial officer will be responsible for the funds and for any required audit. Each applicant will take the necessary steps to comply with the California Environmental Quality Act and any other law or rule concerning obtaining or using the grant money. In individual grant transactions the applicants may, by separate agreement with some or -2- 3 -2 -79 PWH /j 701 -03 701 -05 -001 all of the other cities, provide for sharing of expenses or of disallowed expenses, hold harmless agreements and other matters. If there are no such separate agreements, each applicant is individually responsible for all aspects of the grant transaction, except for administrative services provided under the provisions of Part 6 of this agreement. 5. The term of this agreement is from the date on which it is signed by the last of the cities and the County, through June 30, 1980. Any party may withdraw from this agreement by giving written notices, 90 days beforehand, to the principal executive officers of all of the other parties, at their main offices. Withdrawal is not effective as to transactions in which applications are filed before the effective date of withdrawal. The County and the cities agree: 6. The County will provide all the administrative and planning services required of it by the State of California Office of Criminal Justice Planning in connection with the grants which are the subject of this agreement. The County will not charge the cities for its services. 7. If LEAA funding to the County to pay for its admini- strative and planning services is discontinued, the County may cease its administrative and planning services for grants that have not at that time already been approved, but will continue its -3- 3 -2 -79 PWH /j 701 -03 701 -05 -001 services to completion for approved grants. B. The County will approve all decisions of the Committee concerning the use of the cities' share of LEAA money.
