RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
TO SET A DATE FOR CONSIDERATION OF A REORGANIZATION
OF AN UNINHABITED TERRITORY DESIGNATED
TOPPING WAY NO. 7

WHEREAS, the Town Council of the Town of Los Gatos has received a request for
annexation of territory designated Topping Way No. 7 from Arthur Lin; and
WHEREAS, the property, 0.33 acres located at 16666 Topping Way, APN: 532 -09 -018, is
contiguous to the Town of Los Gatos and within the Town's Urban Service Area; and
WHEREAS, the following special district would be affected by the proposal: Santa Clara
County Library Service Area; and
WHEREAS, the annexation would provide for use of Town services; and
WHEREAS, the Town Council enacted Ordinance 1268 in 1975 pre- zoning the subject
territory with an R -1:8 (single - family residential, 8,000 square foot minimum lot size) zoning
designation; and
WHEREAS, the Town of Los Gatos, as Lead Agency for environmental review for the
reorganization, has determined annexation of the subject property is exempt from the
California Environmental Quality Act guidelines, pursuant to Section 15061(b)(3); and

WHEREAS, the County Surveyor of Santa Clara County has found the description and
map (Exhibits A and B) to be in accordance with Government Code Section 56757, the
boundaries to be definite and certain, and the proposal to be in compliance with LAFCO's road
annexation policies; and
WHEREAS, as provided in Government Code Section 56757, the Town Council of the
Town of Los Gatos shall be the conducting authority for a reorganization including an
annexation to the Town; and
WHEREAS, the territory is uninhabited and all owners of land included in the proposal
have consented to this annexation; and
WHEREAS, Government Code Section 56663(a) provides that if a petition for annexation
is signed by all owners of land within the affected territory the Town Council may approve or
disapprove the annexation without a public hearing.
NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Los Gatos
hereby initiates annexation proceedings and will consider annexation of the territory
designated as Topping Way No. 7 at its regular meeting on September 5, 2017.

Topping Way No. 7
All that certain real property situated in the County of Santa Clara, State of
California, being all of Lot 55 of Tract No. 328 recorded in Book 10 of Maps at

Gatos, more particularly described as follows:
Beginning at a point on the Southerly right of way line of Topping Way (60' wide), said point
being on the existing Town Limit established by the Annexation entitled Topping Way No. 3,
said point also being the Northwesterly corner of said Lot 55;
Thence (1) Easterly 23.29 feet along said Southerly right of way line and Town Limit on a curve
to the left, said curve having a radius of 550.00 feet, delta 2 Degrees 25 Minutes 33 Seconds and
radial bearing North 14 Degrees 33 Minutes 48 Seconds East to a point on the Town Limit as
established by the Annexation entitled Topping Way No. 4;
Thence (2) thence along said right of way and Town Limit South 77 Degrees 51 Minutes 36
Seconds East a length of 64.93 feet to the Northwesterly comer of said Lot 55;
Thence (3) South 12 Degrees 08 Minutes 15 Seconds West a Iength of 137.00 to the
Southwesterly comer of said Lot 55;
Thence (4) North 73 Degrees 20 Minutes 45 Seconds W a length of 133.30 feet to the
Southwesterly corner of said Lot 55 and Northeasterly corner of the Town Limit, established by
Annexation entitled Marchniont Drive No. 4 and Southeasterly corner of the Town Limit
established by said Annexation entitled Topping Way No. 3;
Thence (5) along the Town Limit established by said Annexation entitled Topping Way No. 3
North 32 Degree 39 Minutes 45 Seconds East a length of 127.14 feet;
Thence (6) North 12 Degrees 51 minutes 45 Seconds East a length of 7.93 feet to the point of
beginning.
Containing 0.33 acres more or less.
