M10-18-16 Town Council Meeting 11/01/16 Item #1 MINUTES OF THE TOWN COUNCIL MEETING OCTOBER 18, 2016 The Town Council of the Town of Los Gatos conducted a Special Meeting on Tuesday, October 18, 2016, to hold a Closed Session at 6:00 p.m. and a Regular Meeting at 7:00 p.m. CLOSED SESSION – 6:00 P.M. CONFERENCE WITH LABOR NEGOTIATOR (Government Code Section 54957.6) CS-1 To meet with Town Negotiators listed below regarding negotiations with the Employee Organizations listed below: Town Negotiators (Lead): Allyson Hauck, Renne, Sloan, Holtzman, Sakai LLP Laurel Prevetti, Town Manager Employee Organizations: Town Employees’ Association (TEA) American Federation of State County and Municipal Employees Local No. 101 (AFSCME) Police Officers’ Association (POA) CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Government Code Section 54956.9 [d][1]) CS-2 Eden Housing Inc., Summerhill Homes LLC, and Grosvenor USA Limited v. Town of Los Gatos CS-3 Town of Los Gatos vs. California Department of Transportation (Caltrans) and Valley Transportation Authority (VTA) MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Barbara Spector, Vice Mayor Marico Sayoc, Council Member Marcia Jensen, Council Member Steve Leonardis, Council Member Rob Rennie. Absent: None PLEDGE OF ALLEGIANCE Brady Munnerlyn led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Spector presented a Small Business, Big Applause Commendation to Bunches. CLOSED SESSION REPO RT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL/TOWN MANAGER REPORTS Council Matters Council Member Marcia Jensen stated she had nothing to report. - Council Member Rob Rennie stated he attended the League of California Cities Conference, - the Ad Hoc Parking and infrastructure Committee meeting along with the Mayor, the Silicon Valley Clean Energy Authority Board Meeting, the VTA Policy Advisory Committee meeting, and the Cities Association Board meeting. Mayor Barbara Spector stated she attended the Listowel Literary kickoff event (a Sister City - of Los Gatos) at C.B. Hannegan’s and opening reception at NUMU, the West Valley Mayor/Manager meeting with Town Manager Laurel Prevetti, and the opening of the new Superior Court. Vice Mayor Marico Sayoc stated she read at the Preschool Story Time at the Library, and - she attended the Council Policy Committee meetings along with Council Member Jensen. Council Member Steve Leonardis stated he read at the Preschool Story Time at the Library, - and he attended the West Valley Sanitation District Board of Directors meeting and the Treatment Plant Advisory Committee meeting. Manager Matters Announced that the neighbors on Tait will be receiving a letter from the Police Department - advising the street will be closed on Halloween and the Town is working with the contractor doing the street improvements on Bachman to ensure the safety of the trick or treaters. Announced that the recruitment for adult Commissioners for Boards and Commissions is - underway. Announced that the Town is working with San Jose Water Company to set up a community - meeting to discuss the recent water bills. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1.Approve Council Minutes of September 27, 2016. 2.Approve Council Minutes of October 4, 2016. 3.Discuss and adopt the Policy Committee's recommendation for a Flag. POLICY 5-02 4.Request for Authorization to enter into a Legal Services Agreement for Litigation Defense in the Matter of Eden Housing Inc., Summerhill Homes LLC, and Grosvenor USA Limited v. Town of Los Gatos for a Total Contract Not-To-Exceed Amount of $100,000. MOTION: Motion by Council Member Marcia Jensen to approve the Consent Items, inclusive of the Flag Policy contained in Attachment 2 of the staff report. Seconded by Council Member Steve Leonardis. VOTE: Motion passed unanimously. 2 of 7 Town Council Meeting Minutes October 18, 2016 VERBAL COMMUNICATIONS John Shepardson Commented on the Town pursuing grants for superfast electric charger stations; he - suggested the Town prepare a report after major projects are complete for future Councils to see what occurred and what the Town can learn from them; he is encouraged that children are using the flags at crosswalks on Santa Cruz Avenue; he suggested a Finance Committee be set up that includes citizens; he has noticed that kids are biking more and expressed thanks to those who are promoting the Safe Routes to School program; he commented that the progress in the energy program is good; he noticed the kids are creating really cool artistic stuff at NUMU; and he suggested the Town enter into a friendly and fierce competition with Saratoga to see who can reduce their greenhouse emissions. Ed Morimoto Commented on the special meeting of the General Plan Committee and questioned the - validity of pursuing amendments to the North 40 Specific Plan while the project is going through a lawsuit. Angelia Doerner Commented in support of the General Plan Committee special meeting to review possible - amendments to the North 40 Specific Plan; encouraged all to attend the Tait Avenue Halloween event; and requested Wilder also be closed for safety. PUBLIC HEARINGS 5.Adopt an Ordinance of the Town Council of the Town of Los Gatos amending Town Code Chapter 14 Article XI. - Massage Therapy Establishments and Massage Therapy Practitioners. Robert Schultz, Town Attorney, requested the matter be continued to November 1, 2016 to allow new State laws that have occurred to be incorporated. Opened and closed Public Comment. MOTION: Motion by Council Member Marcia Jensen to continue the matter to November 1, 2016 in order to consider any changes to the Town’s ordinances regarding the subject matter to conform to State law. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. 3 of 7 Town Council Meeting Minutes October 18, 2016 OTHER BUSINESS 6.Authorize the Town Manager to issue a Request for Proposal (RFP) for the sale of the property on Dittos Lane APN 529-29-034. Matt Morley, Director of Parks and Public Works, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Steve Leonardis to approve the staff recommendation contained in the staff report. Seconded by Council Member Rob Rennie. VOTE: Motion passed 4/1. Council Member Marcia Jensen voting no. 7.Receive the report on traffic and parking around schools. Matt Morley, Director of Parks and Public Works, presented the staff report. Opened Public Comment. Thomas Cook, Safe Routes to School representative Thanked all who have been involved for all their hard work; announced a nonprofit entity - has been formed called Los Gatos Monte Sereno Safe Routes to School, and thanked all who were involved in the formation of the nonprofit and their support of the Memorandum of Understanding (MOU). Karen Briones, Los Gatos Safe Routes to School representative Thanked the Town for the pedometers that were given to students and provided an update - on the number of steps taken in the “Walk to Washington” in the Where Will Your Feet Take You program. Emi Eto, Los Gatos Union School District Trustee and representative/liaison to the Town Provided an update on Safe Routes to School. - Closed Public Comment. Council discussed the matter. 4 of 7 Town Council Meeting Minutes October 18, 2016 Other Business Item #7 – continued MOTION: Motion by Council Member Marcia Jensen to receive the report; thank everyone who has been a part of it; do items that cost nothing right away; look at items costing $2500 to $10,000 that may be able to get done right away; to categorize projects by the greatest impact for the money spent; use our Commissions and Safe Routes to School to help set priorities where these things should be taking place; identify funding sources early and often; return to Council as soon as possible; and start implementing the ideas. Seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously. 8.Whitney Avenue Residential Permit Parking and Residential Parking Options. JR Langer, Police Lieutenant, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to defer the matter to the January 2017 priority/budget discussion with information on cost recovery and results of the Alpine pilot study. Seconded by Council Member Steve Leonardis. Motion was withdrawn by Council Member Jensen and picked up by Council Member Leonardis. Motion died for lack of a second. MOTION: Motion by Council Member Marcia Jensen to accept the staff recommendation for the pilot program on Whitney and direct staff to return to Council with: 1) the results of the Alpine pilot program; 2) information on cost recovery, both how much it costs up front to go through a study and a permit process under the existing policy; 3) what it costs for enforcement ongoing and how we can recover that; 4) if the cost of the permit is increased should it be increased Town-wide, or only in certain areas; 5) get data, if possible, from the high school as to whether or not the lack of parking in residential areas affects whether they drive to school; 6) if the permit parking needs to be looked at differently, it should go to the Policy Committee for examination; and 7) the policy portion should return to Council in time for a decision on the budgeting in January. What other metrics is Los Gatos High School able to use so that we can tell if limiting - parking is actually getting people out of cars? 9.Receive a report on regional transportation funding efforts and potential projects. Matt Morley, Director of Parks and Public Works, presented the staff report. Council asked questions of staff. Opened Public Comment. Diana Abbatti, Los Gatos Union School District Superintendent Thanked the Town for all the hard work and requested that the District be kept informed of - any decisions made about school busing. Closed Public Comment. 10.Receive a report on pathway lighting options along the Forbes Mill footbridge. Matt Morley, Director of Parks and Public Works, presented the staff report. Opened and closed Public Comment. Council discussed the matter. Direction to staff: return to Council in January with costs and options. 11.Discuss and adopt amendments to Council Policy 1-04 entitled Town Facilities Use Policy regarding Oak Meadow Park. POLICY 1-04 Shelayne Hammack, Management Analyst, presented the staff report. Opened and closed Public Comment. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. 12.Review and discuss the Council Policy Committee's recommendations to amend Council Policy 2-11 entitled Commission Appointments. POLICY 2-11 RESOLUTIONS 2016-051, 2016-052, 2016-053, 2016-054, 2016-055, 2016-056, 2016-057, 2016-058, 2016-059, and 2016-060 Robert Schultz, Town Attorney, presented the staff report. Opened Public Comment. Maria Ristow Commented in favor of the proposed changes. - Lee Fagot Requested that Council add three residents to the Finance Committee and revamp the - budget process. Closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Steve Leonardis to approve the staff recommendation on page one of the staff report, including the correction on page two of the Policy to reflect Commissioners can be removed with a 3/5 vote of Council, and to remove reference to a business owner in the General Plan Committee enabling Resolution. Seconded by Council Member Marcia Jensen. VOTE: Motion passed 4/1. Council Member Rob Rennie voting no.
