RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL
OF DIRECTOR OF BUILDING SERVICES DECISION TO ISSUE
A "NOTICE AND ORDER" FOR SUBSTANDARD HOUSING CONDITIONS
AT TOBY'S MOTEL
(214 E. MAIN STREET /EVA V. OGILVIE)
WHEREAS:
A. Eva V. Ogilvie, owner /appellant, has appealed a decision of the Director of
Building Services as follows: issuance of a 'Notice and Order" for substandard housing
conditions at Toby's Motel.
B. Applicant stated that purpose of protest was to determine whether it is financially
feasible to demolish Toby's Motel. If it is not cost prohibitive, applicant would like to
determine if it is possible to bring the structure up to Code.
C. Denial of Applicant's appeal will allow Applicant to pursue both of the options.
D. A public hearing was held on May 20, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds no evidence or testimony was presented that
the decision of the Director of Building Services was in error.
B. The Town Council further finds that occupancy of Toby's Motel will be allowed
only when the units can be determined to be safe and habitable.
C. The Town Council further finds that the buildings at Toby's Motel are to be
secured.
D. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 3rd day of June, 1991 by the following vote.
