RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING AN APPEAL OF A DECISION OF THE PLANNING COMMISSION
GRANTING APPROVAL TO MODIFY EXISTING APPROVALS GRANTED
TO CONSTRUCT A SINGLE- FAMILY DWELLING TO REPLACE THE ONE
DAMAGED IN THE EARTHQUAKE ON PROPERTY IN THE R- 1:10,000

A. Martin Lettunich, property owner and appellant, has appealed a decision of the
Planning Commission approving a request for modifications to existing approvals granted
to construct a single - family dwelling to replace the one damaged in the earthquake on
property in the R- 1:10,000 zone located at 220 Hollywood Avenue. Architecture and Site
Application S- 89 -71C.
B. The original home at 220 Hollywood Avenue was demolished due to earthquake
damage in November 1989. The Town Council has considered two previous appeals
regarding plans for replacement of the structure.
C. Appellant proposes to convert an existing basement to habitable floor area, to
modify unconditioned space on the second and third floors, and to make exterior changes
to the single - family residence currently under construction.
D. A public hearing was held on June 17, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the Planning Commission did not err in
their decision to deny conversion of unconditioned floor area to habitable floor area on the
second and third floors and to approve the plans to make exterior changes, and to convert
the existing 2,740 square foot basement to habitable floor area.
B. The Town Council hereby further requires the applicant to plant and maintain
vegetation at the ground level of the residence.
C. Based on the foregoing findings, the appeal is denied.
D. The modifications of existing approvals are approved on the following conditions:
TO THE SATISFACTION OF THE PLANNING DIRECTOR:
1. The exterior colors of the residence shall be earthtone colors with a
reflectivity value that does not exceed 30.
TO THE SATISFACTION OF THE TOWN ENGINEER:
2. Any existing sanitary sewer lateral proposed for reuse shall be televised and
approved by West Valley Sanitation District.
3. A sanitary lateral clean -out shall be installed at the property line.
4. Any work in the public right -of -way will require a Construction Encroachment
permit.
5. Enter into a five (5) year landscape maintenance agreement with the Town
of Los Gatos to maintain vegetation around the residence.
TO THE SATISFACTION OF THE DIRECTOR OF PARKS, FORESTRY AND
MAINTENANCE SERVICES:
6. The imported soil around the oak trees identified as #4 and #5 on the plans
shall be removed to root flair at the base of the trees.
7. Plant climbing vegetation around the ground level pillars and face of the
residence.
TO THE SATISFACTION OF THE DIRECTOR OF BUILDING SERVICES:
8. Provide a second exit for the third floor, as required by the Uniform Building
Code.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
