RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF DIRECTOR OF BUILDING SERVICES' DECISION TO
REQUIRE ACCESSIBILITY FEATURES
(453 N. SANTA CRUZ AVENUE /TERRY UPTON)
WHEREAS:
A. Terry Upton, owner and appellant, had appealed the decision of the Director
of Building Services requiring accessibility features at 453 North Santa Cruz Avenue;
B. April 30, 1991 claimant was issued a Building Department "Correction Notice"
citing two violations of Building Code handicap access requirements; and
C. A public hearing was held on July 15, 1991.
RESOLVED:
A. The Town Council for the Town of Los Gatos hereby finds that the newly
constructed raised platform is not exempt under California Administrative Code Title 24
and must comply with the handicap access requirements of the State of California Building
Regulations.
B. The Town Council further finds that the Building Director did not err in the
decision to require accessibility features at 453 North Santa Cruz Avenue pursuant to the
California Administrative Code Title 24.
C. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 5th day of August, 1991 by the following vote.
