RESOLUTION OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO SIGN A
LETTER OF AGREEMENT AMENDING THE 1990 AGREEMENT
WITH BRIAN KANGAS FOULK
FOR PARKING LOT #4 STRUCTURAL MODIFICATIONS
RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa
Clara, State of California, that the Town of Los Gatos enter into The Letter of Agreement
(attached as Exhibit A) amending the 1990 agreement with Brian Kangas Foulk for Parking
Lot #4 structural modifications, and that the Town Manager is authorized, and is hereby
directed, to execute said Letter of Agreement in the name and on behalf of the Town of Los
Gatos.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 18th day of February, 1992 by the following
vote:

FOR 1992 BIDDING
Dear Mr. Linder:
Brian Kangas Foulk is pleased to present this proposal for additional design services on
the Lot 4 Parking project. Our proposal is based on our January 3, 1992 meeting with
Town staff to discuss the proposed revisions to the plans.
The most important aspect of these plan revisions is your desire to provide future
potential for retail space at the ends of the parking structure. You indicated that you
would like to create the potential for an outdoor garden area or seating area at the ends
of the structure with particular emphasis on Elm Street. The creation of these seat /bench
areas may also provide for incorporation of street trees at street level at the ends of the
structure.
In order to provide for the future retail space, we would provide sleeves in the slab that
would allow plumbing to be routed through the upper deck and connect to street
services in the future. You would also like us to provide an electrical conduit sleeve to
each end of the structure in order to make potential service easier to accomplish.
In addition to providing for potential retail space, you had asked us to consider restriping
the lot to conform with the recent changes to the Los Gatos Parking Ordinance which
would result in a few additional stalls. You would like us to provide sleeves for parking
meters; to review the possibility of creating moveable planters in the areas that may be
used for future retail space; to identify a potential site for a pay phone in the garage area
for visitor convenience; and to further enhance the streetscape. We propose the
following not -to- exceed fees:

If this proposal is acceptable to you, please indicate by signing below, and will follow up
with the paperwork for a formal amendment to our previously existing contract. We look

Dear Frans:
We are pleased that the. Hazardous Waste Material Remediation for
Parking Lot No. 4 is progressing well. At your request, we have reviewed
the parking structure plans and specifications to assess the revisions
necessary to re- advertise the construction contract concurrent with the
remediation work. Our proposed scope of work is as follows:

1. Perform a site survey to obtain spot

This data will be used to define the extent
of grading necessary to complete the parking

2. Revise plans to incorporate new demolition

changes which have come about since the first
construction contract (e.g., vault, additional
upper level loading ramp, and deleting the canopy
opening).
3. Coordinate with utility companies to update bid
quantities, provide vent for P.G. & E. vault, 900.00
and analyze construction scheduling.
4. Revise specifications to reflect new bid quantities, 1,600.00
remediation work, the interim parking lot, and
other miscellaneous changes.

We offer to perform these services for a lump sum fee of $ 7,900.00.
Reimbursable expenses, such as consultants, computer time, printing
costs, delivery charges, and mileage will be billed separately on a time
and materials basis (approximately $ 950.00 is anticipated). The revised
plans and specifications could be ready for advertisement on March 12,
1991 (approximate date). You should also note the following items.
o Parking meters (or sleeves for them) could be added to the bid
package if the Town has resolved this issue.
o The current advertising schedule does not allow for a review by the
Town. However, your comments could be incorporated if received
very soon.
o The utility easement on Zucconi's property will need to be acquired
if it has not been done already.
• Remediation backfill may affect footing designs.
• We have assumed that the existing building permit is still valid.

Gentlemen:
Biggs Cardosa Associates, Inc. is pleased to submit the following
proposal to provide additional structural engineering services on the
subject project.
Biggs Cardosa Associates, Inc. completed the structural drawings for
the subject project in 1988. Construction for the project was
haulted almost immediately after it began due to hazardous materials
found at the site during excavation. The site has now been cleaned
and construction of the project may resume. Biggs Cardosa
Associates, Inc has been asked to submit a proposal to review the
original drawings and update them so that they may be rebid. In
addition we have also been requested to redetail a planter at the
upper level so that it can be removable, as well as provide a
retaining wall to allow widening one of the walkways into the
structure.
Biggs Cardosa Associates, Inc. proposes to provide the general scope
of services as outlined below:

Biggs Cardosa Associates, Inc. proposes to provide the above scope of
services on a fixed fee basis of $10,000.00.
The parking structure was designed in accordance with the 1985 UBC.
There have been a number of changes in the 1988 and 1991 codes.
Please advise us if the Town of Los Gatos wishes to update the
parking structure design as this is not included in the fee proposal
outlined above.
