RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
RECOMMENDING AMENDMENTS TO THE GENERAL PLAN AND DOWNTOWN
SPECIFIC PLAN TO CARRY OUT THE IMPLEMENTATION MEASURES FOR
AREAS 8 & 9 OF THE COMMERCIAL SPECIFIC PLAN
COMMITTEE'S FINAL REPORT
WHEREAS, the Commercial Specific Plan Committee's Final Report (Commercial
Plan) approved on May 15, 1991, by the Town Council recommends specific changes that
impact land use and development policy; and
WHEREAS, the Implementation Measures of the Commercial Plan are intended to
preserve and enhance the Town's diversity of retail and service businesses.
WHEREAS, pursuant to provisions of Government Code Sections 65353 and 65453,
the Planning Commission of the Town of Los Gatos conducted a public hearing for
consideration of amendments to the General Plan and Downtown Specific Plan on
August 26, 1992; and
WHEREAS, the Town Council considered Downtown Specific Plan Amendment
DSP -92 -1 and General Plan Amendments GP -92 -5 relating to Areas 8 and 9 of the
Commercial Plan.
RESOLVED: the Town Council approves the Negative Declaration and finds that
the amendments will not have a significant impact on the environment.
FURTHER RESOLVED: The Town Council finds that Los Gatos General Plan
Amendment GP -92 -5 is (a) internally consistent with the Town General Plan, and (b) that
all proceedings have been conducted in compliance with the provisions of Government
Code Section 65350 et seq.
The Town Council amends Section 2.5.2.a of the General Plan Land Use Element
be amended as follows:
a. CBD - CENTRAL BUSINESS DISTRICT
This designation, utilized exclusively in the Town Center and intended to
encourage the continued development of a strong core of community- oriented
commercial goods and services, is unique in its accommodation of small,
village or town style merchants, its intent to maintain and expand landscaped

open spaces and mature tree growth, its integration of new construction with
existing structures of historical or architectural significance, and its emphasis
on the importance of the pedestrian. New construction in the CBD shall be
limited to a Floor Area Ratio (FAR) of .6 and a height limit of 45 feet. All
new construction will be limited by the traffic capacity of the streets serving
the area. To maintain a strong tax base and further the goals of pedestrian
orientation, ground floor commercial space with street frontage should be
reserved for retail uses in the Downtown Area.
FURTHER RESOLVED: The Town Council find that Downtown Specific Plan
Amendment DSP -92 -1 meets the requirements for a specific plan, (b) is consistent with the
Town of Los Gatos General Plan, and (c) that all proceedings have been conducted in
compliance with the provisions for Government Code Section 65453 et seq.
FURTHER RESOLVED: The Town Council recommends that Policies 5 and 7 of
the Downtown Specific Plan Land Use Element be amended as follows:
Downtown Specific Plan
5. The different functions, land use patterns, and use mixes of commercial areas
within the downtown shall be recognized and encouraged. This includes:
■ The pedestrian scale, specialty orientation of the CBD.
■ The convenience shopping land use pattern of areas north of Saratoga
Avenue to Blossom Hill Road, and
■ The mixed use commercial activities along Santa Cruz Avenue and the
service commercial activities along University Avenue between
Andrews, Roberts, and Blossom Hill Roads.
7. Conversion of historically designated residential structures to commercial may
be allowed consistent with the Town's policies regarding historic preservation.
FURTHER RESOLVED: The Town Council amends the General Plan Land Use
Map as shown on Exhibit A, attached hereto and incorporated by reference.
FURTHER RESOLVED: The Town Council amends the Downtown Specific Plan
Land Use Plan as shown on Exhibit B attached hereto and incorporated by reference.
