RESOLUTION OF THE TOWN OF LOS GATOS
ESTABLISHING A PROCESS AND ORDER OF SUCCESSION
DURING THE ABSENCE OR UNAVAILABILITY OF THE TOWN MANAGER
WHEREAS, in order to ensure that Town business would continue if the Town
Manager were absent or unavailable, it is necessary to establish a process and order of
succession; and
WHEREAS, Government Code Sections 8635 and following permit provision
for succession of Town officers in order to continue local government in case of emergency,
NOW, THEREFORE, BE IT RESOLVED:
1. In case the Town Manager is absent from the Town, the Town Manager
may designate another Town officer in the following order to serve as the Acting Town
Manager during the Manager's absence:
Number 1: Assistant Town Manager
Number 2: Chief of Police
Number 3: Planning Director
The Town Manager shall communicate this designation to the officer and
the Council and in the designation may delimit the authority of the Acting Town Manager
as the Town Manager may determine. An officer serving as Acting Town Manager under
this paragraph shall serve as Acting Town Manager only for so long as the Town Manager
designates.
2. In case the Town Manager is unavailable, another Town officer in the
following order will serve as the Acting Town Manager during the Manager's unavailability:
Number 1: Assistant Town Manager
Number 2: Chief of Police
Number 3: Planning Director
For purposes of this resolution, "unavailable" means that the officer has
been killed, is missing, or is so seriously injured or disabled as to be unable to attend to and
perform the officer's duties. An officer serving as Acting Town Manager under this
paragraph shall serve as Acting Town Manager only for so long as an officer higher in the
order of succession is unavailable.

3. An officer serving as Acting Town Manager may designate another to serve
as provided in paragraph 1 above and shall be subject to the provisions regarding
unavailability defined in paragraph 2 above.
4. In addition to the other provisions of this Resolution, an officer serving as
Acting Town Manager shall serve as Acting Town Manager only for so long as the Town
Council has not appointed a different person to serve as either Town Manager or Acting
Town Manager. In any event, the process and protections provided in Sections 2.30.285
and 2.30.290 do not apply to the removal or replacement of any person serving as Acting
Town Manager pursuant to this Resolution.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 1st day of November, 1993 by the following
vote:
