RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
INITIATING PROCEEDING FOR THE
ANNEXATION OF CERTAIN UNINHABITED TERRITORY
DESIGNATED AS LOS GATOS BOULEVARD NO. 13 TO THE
TOWN OF LOS GATOS
WHEREAS, the Town of Los Gatos desires to provide municipal services to all
residents with its Urban Service Area boundary, and
WHEREAS, the proposed annexation to the Town of Los Gatos consisting of all that
unincorporated territory known as Los Gatos Boulevard No. 13, located along the east side
of Los Gatos Boulevard and the North side of Shannon Road in the County of Santa Clara
is proposed for annexation to the Town of Los Gatos pursuant to Division 3, commencing
with Section 56000 et seq. of the Government Code; and
WHEREAS, the Town Council is satisfied that owners of land included in said
annexation desire to annex to the Town of Los Gatos in order to receive municipal services.
NOW, THEREFORE, the Town Council of the Town of Los Gatos of the County
of Santa Clara DOES HEREBY RESOLVE, DETERMINE and ORDER as follows:
1. The Town of Los Gatos is the conducting authority and hereby initiates
annexation proceeding pursuant to Section 56826 of the Government Code.
Proceedings of the Los Gatos Town Council will be held pursuant to Section
57000 et. seq.
2. The territory proposed to be annexed is designated as Los Gatos Boulevard
No. 13 Annexation, and the boundaries are described in the real property
description and map attached hereto marked Exhibits "A" and 'B ",
respectively.
3. The territory proposed to be annexed is uninhabited as defined by Section
56046 of the Government Code.
4. The reason for the proposed annexation is to properly plan and provide
municipal services to the area which is contiguous to the Town.

5. A hearing will be held on December 6, 1993, at a meeting of the Town
Council beginning at 7:30 p.m., in the Council Chambers of the Civic Center,
110 East Main Street, Los Gatos, California, during which the Town Council
will hear protests against the annexation.
6. Since the territory is uninhabited, the law provides that any owner of land
within the territory may file a written protest against the annexation with the
Town Clerk at any time prior to the conclusion of the Town Council's hearing
on the proposed annexation.
7. The Town Council has determined that the annexation is Categorically
Exempt from the provision CEQA, California Administrative Code Section
15319(a) and (b).
FURTHER RESOLVED: The Town Clerk is directed to cause notice of the hearing
on the proposed annexation to be given as provide in section 57025 and Sections 56150-
56159 of the Government Code, and said notice shall include all the information specified
in Section 57025 of the Government Code.
PASSED AND ADOPTED at a regular meeting of the Town Council held on the 1st
day of November, 1993, by the following vote:

'Description to accompany annexation of territory known as
LOS GATOS BOULEVARD NO. 13
to the Town of Los Gatos
All that certain real property situated in the County of Santa Clara, State of
California, more particularly described as follows:
BEGINNING at a point along the southerly boundary of that certain
annexation to the Town of Los Gatos known as Magneson Avenue No. 1
southwesterly
1) S 20° 40' W, 54.71 feet;
2) thence continuing along said Magneson Avenue No. 1 Annexation S 78° 52' 10" E,
60.00 feet to the most southerly corner of said Magneson Avenue No, 1 Annexation
and the most southwesterly corner of that certain annexation to the Town of Los
Gatos known as Magneson Avenue No. 4;
3) thence continuing southeasterly along said Magneson Avenue No. 4 Annexation S
78° 54' E, 300 feet, more or less, to a point, said point also being the northeasterly
corner of the Land of Fiorentino, as shown on that Quitclaim Deed filed for record
on February 8, 1978 in Book B 856 of Official Records, page 504, Santa Clara
County Records;
4) thence leaving said Magneson Avenue No. 4 Annexation and continuing along said
Land of Fiorentino, S 20° 40' W, 161.00 feet to a point on the northerly boundary
of that certain annexation to the Town of Los Gatos known as Shannon Road No.
15, and the northerly right -of -way line of Shannon Road, 25 feet perpendicularly
from the centerline;
5) thence continuing along the said Shannon Road No. 15 annexation and the northerly
right -of -way line of Shannon Road N 78° 54' W, 255 feet, more or less;
6) thence N 200 40' E, 5.07 feet;
7) thence N 78° 52' 10" W, 178.12 feet to the northwesterly corner of said Shannon
Road No. 15 Annexation;

Avenue No. 1, on a convex curve to the right with a radius of 45.00 feet, a central
angle of 990 32' 10" for a distance of 78.18 feet;
9) thence continuing along said Bascom Avenue No. 1 Annexation and the easterly
right -of -way line of Los Gatos Boulevard (formerly known as San Jose -Los Gatos
Road and as Bascom Avenue) N 20° 40'E, 157.45 feet to a northeasterly corner of
said Bascom Avenue No. 1 Annexation and a point along a southerly line of that
certain annexation to the Town of Los Gatos known as Magneson Avenue No. 1;
10) thence continuing along said Magneson Avenue No. 1 Annexation S 78° 52' 10" E,
113.11 feet to the Point of Beginning.
